An Act to amend the Criminal Code (trafficking in persons)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 7 of the Criminal Code is amended by adding the following after subsection (4.1):

1. L’article 7 du Code criminel est modifié par adjonction, après le paragraphe (4.1), de ce qui suit :

Offence in relation to trafficking in persons

(4.11) Notwithstanding anything in this Act or any other Act, every one who, outside Canada, commits an act or omission that if committed in Canada would be an offence against section 279.01, 279.011, 279.02 or 279.03 shall be deemed to commit that act or omission in Canada if the person who commits the act or omission is a Canadian citizen or a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act.

(4.11) Malgré les autres dispositions de la présente loi ou toute autre loi, le citoyen canadien ou le résident permanent au sens du paragraphe 2(1) de la Loi sur l’immigration et la protection des réfugiés qui, à l’étranger est l’auteur d’un fait — acte ou omission — qui, s’il était commis au Canada, constituerait une infraction aux articles 279.01, 279.011, 279.02 ou 279.03 est réputé l’avoir commis au Canada.

2. Section 279.04 of the Act is replaced by the following:

279.04 (1) For the purposes of sections 279.01 to 279.03, a person exploits another person if they cause them to provide, or offer to provide, labour or a service by engaging in conduct that, in all the circumstances, could reasonably be expected to cause the other person to believe that their safety or the safety of a person known to them would be threatened if they failed to provide, or offer to provide, the labour or service.

279.04 (1) Pour l’application des articles 279.01 à 279.03, une personne en exploite une autre si elle l’amène à fournir son travail ou ses services, par des agissements dont il est raisonnable de s’attendre, compte tenu du contexte, à ce qu’ils lui fassent croire qu’un refus de sa part mettrait en danger sa sécurité ou celle d’une personne qu’elle connaît.

Factors

(2) In determining whether an accused exploits another person under subsection (1), the Court may consider, among other factors, whether the accused

(a) used or threatened to use force or another form of coercion;

(b) used deception; or

(c) abused a position of trust, power or authority.

(2) Pour déterminer si un accusé exploite une autre personne au titre du paragraphe (1), le tribunal peut notamment prendre en compte les faits suivants :

a) l’accusé a utilisé ou menacé d’utiliser la force ou toute autre forme de contrainte;

b) il a recouru à la tromperie;

c) il a abusé de son pouvoir ou de la confiance d’une personne.

Organ or tissue removal

(3) For the purposes of sections 279.01 to 279.03, a person exploits another person if they cause them, by means of deception or the use or threat of force or of any other form of coercion, to have an organ or tissue removed.

(3) Pour l’application des articles 279.01 à 279.03, une personne en exploite une autre si elle l’amène, par la tromperie ou la menace ou l’usage de la force ou de toute autre forme de contrainte, à se faire prélever un organe ou des tissus.
