USE OF SPIRIT DRINK NAMES

UTILISATION DES NOMS DE SPIRITUEUX

1. (1) A spirit drink may be sold using the name Grappa if it has been produced exclusively in Italy.

1. (1) Le nom sous lequel un spiritueux peut être vendu peut comporter le nom Grappa s’il a été fabriqué exclusivement en Italie.

(2) A spirit drink may be sold using the name Grappa di Ticino if it has been produced in the Ticino region of Switzerland.

(2) Le nom sous lequel un spiritueux peut être vendu peut comporter le nom Grappa di Ticino s’il a été fabriqué dans la région du Tessin en Suisse.

2. A spirit drink may be sold using the name Jägertee, Jagertee or Jagatee if it has been produced exclusively in Austria.

2. Le nom sous lequel un spiritueux peut être vendu peut comporter les noms Jägertee, Jagertee ou Jagatee s’il a été fabriqué exclusivement en Autriche.

3. A spirit drink may be sold using the name Korn or Kornbrand if it has been produced exclusively in Germany or Austria.

3. Le nom sous lequel un spiritueux peut être vendu peut comporter les noms Korn ou Kornbrand s’il a été fabriqué exclusivement en Allemagne ou en Autriche.

4. A spirit drink may be sold using the name Ouzo or Oύζo if it has been produced exclusively in Greece.

4. Le nom sous lequel un spiritueux peut être vendu peut comporter les noms Ouzo ou Oύζo s’il a été fabriqué exclusivement en Grèce.

5. A spirit drink may be sold using the name Pacharán if it has been produced exclusively in Spain.

5. Le nom sous lequel un spiritueux peut être vendu peut comporter le nom Pacharán s’il a été fabriqué exclusivement en Espagne.

6. Scotch whisky may be sold under that name if it has been distilled in Scotland as Scotch whisky for domestic consumption in accordance with the laws of the United Kingdom.

6. Le whisky écossais peut être vendu à ce titre s’il a été distillé en Écosse comme whisky écossais pour la consommation domestique, conformément aux lois du Royaume-Uni.

7. Irish whisky may be sold under that name if it has been distilled in Northern Ireland or in the Republic of Ireland as Irish whisky for domestic consumption in accordance with the laws of Northern Ireland or the Republic of Ireland.

7. Le whisky irlandais peut être vendu à ce titre s’il a été distillé en Irlande du Nord ou dans la République d’Irlande comme whisky irlandais pour la consommation domestique, conformément aux lois de l’Irlande du Nord ou de la République d’Irlande.

8. Armagnac brandy may be sold under that name if it has been manufactured in the Armagnac district of France in accordance with the laws of the French Republic for consumption in that country.

8. L’armagnac peut être vendu à ce titre s’il a été fabriqué dans la région d’Armagnac, en France, conformément aux lois de la République française pour la consommation dans ce pays.

9. Cognac brandy may be sold under that name if it has been manufactured in the Cognac district of France in accordance with the laws of the French Republic for consumption in that country.

9. Le cognac peut être vendu à ce titre s’il a été fabriqué dans la région de Cognac, en France, conformément aux lois de la République française pour la consommation dans ce pays.

10. Bourbon whiskey may be sold under that name if it has been manufactured in the United States in accordance with the laws and regulations of the United States governing the manufacture of Bourbon whiskey.

10. Le whisky connu sous le nom de bourbon peut être vendu à ce titre s’il a été fabriqué aux États-Unis conformément aux lois et règlements des États-Unis régissant la fabrication des produits de ce nom.

11. Tennessee whiskey may be sold under that name if it has been manufactured in the United States in accordance with the laws and regulations of the United States governing the manufacture of Tennessee whiskey.

11. Le whisky connu sous le nom de Tennessee Whiskey peut être vendu à ce titre s’il a été fabriqué aux États-Unis conformément aux lois et règlements des États-Unis régissant la fabrication des produits de ce nom.

12. Tequila may be sold under that name if it has been manufactured in Mexico in accordance with the laws and regulations of Mexico governing the manufacture of Tequila.

12. La tequila peut être vendue à ce titre si elle a été fabriquée au Mexique conformément aux lois et règlements du Mexique régissant la fabrication de ce produit.

13. Mezcal may be sold under that name if it has been manufactured in Mexico in accordance with the laws and regulations of Mexico governing the manufacture of Mezcal.

13. Le mezcal peut être vendu à ce titre s’il a été fabriqué au Mexique conformément aux lois et règlements du Mexique régissant la fabrication de ce produit.

14. (1) Caribbean rum may be sold under that name if it has been

14. (1) Le rhum antillais peut être vendu à ce titre dans les cas suivants :

(a) made from sugar cane products of a Commonwealth Caribbean country and distilled and fermented in a Commonwealth Caribbean country; or

a) il a été obtenu des produits de la canne à sucre d’un pays des Antilles du Commonwealth et distillé et fermenté sur place;

(b) imported in bulk from a Commonwealth Caribbean country for bottling and sale in Canada as Caribbean rum and blended or modified by

b) il a été importé en vrac d’un tel pays aux fins d’embouteillage et de vente au Canada à ce titre, et, selon le cas :

(i) blending it with other rum of a Commonwealth Caribbean country,

(i) il a été mélangé avec d’autre rhum d’un pays des Antilles du Commonwealth,

(ii) blending it with Canadian rum in proportions that result in 1 to 1.5% Canadian rum by volume in the final product,

(ii) il a été mélangé avec du rhum canadien de telle sorte que la proportion de rhum canadien dans le produit final soit entre 1 et 1,5 pour cent par volume,

(iii) adding distilled or otherwise purified water to adjust the rum to the strength stated on the label applied to the container, or

(iv) adding caramel.

(2) In this section, “Commonwealth Caribbean country” means Anguilla, Antigua and Barbuda, the Bahamas, Barbados, Belize, Bermuda, the British Virgin Islands, the Cayman Islands, Dominica, Grenada, Guyana, Jamaica, Montserrat, St. Christopher and Nevis, Saint Lucia, St. Vincent and the Grenadines, Trinidad and Tobago and the Turks and Caicos Islands.

(2) Au présent article, « pays des Antilles du Commonwealth » s’entend de Anguilla, Antigua-et-Barbuda, Bahamas, Barbade, Belize, Bermudes, îles Caïmans, Dominique, Grenade, Guyana, Jamaïque, Montserrat, Saint-Christophe-et-Nevis, Sainte-Lucie, Saint-Vincent-et-les Grenadines, Trinité-et-Tobago, des îles Turques et Caïques et des îles Vierges britanniques.
