SOMMAIRE
Le texte modifie le Code criminel afin de préciser ce qui constitue de l’exploitation lorsqu’il est question d’établir si une personne a commis l’infraction de traite de personnes.
SUMMARY
This enactment amends the Criminal Code to specify what constitutes exploitation for the purpose of establishing whether a person has committed the offence of trafficking in persons.

1 (1) Le paragraphe 279.04(1) du Code criminel est remplacé par ce qui suit :
1 (1) Subsection 279.04(1) of the Criminal Code is replaced by the following:

279.04 (1) Pour l’application des articles 279.01 à 279.03, une personne en exploite une autre si, par ses agissements, à la fois :
a) elle l’amène à fournir — ou à offrir de fournir — son travail ou ses services;
b) à l’égard de toute personne, elle utilise ou menace d’utiliser la force ou toute autre forme de contrainte, elle recourt à la tromperie ou à la fraude, elle abuse de son pouvoir ou de la confiance de la personne ou elle commet tout autre acte semblable.
279.04 (1) For the purposes of sections 279.01 to 279.03, a person exploits another person if they engage in conduct that
(a) causes the other person to provide or offer to provide labour or a service; and
(b) involves, in relation to any person, the use or threatened use of force or another form of coercion, the use of deception or fraud, the abuse of a position of trust, power or authority, or any other similar act.
(2) Le paragraphe 279.04(2) de la même loi est abrogé.
(2) Subsection 279.04(2) of the Act is repealed.
