SUMMARY
This enactment amends the definition of “employer” in section 285.01 of the National Defence Act and fixes the day on which sections 285.01 to 285.13 of that Act come into force.

1. Section 285.01 of the National Defence Act, as enacted by section 80 of chapter 15 of the Statutes of Canada, 2004, is replaced by the following:
1. L’article 285.01 de la Loi sur la défense nationale, édicté par l’article 80 du chapitre 15 des Lois du Canada (2004), est remplacé par ce qui suit :
Definitions
285.01 The following definitions apply in this Part.
“employer”
« employeur »
“employer” means an employer operating any federal work, undertaking or business as defined in the Canada Labour Code and includes any corporation established to perform any function or duty on behalf of the Government of Canada.
“Minister”
« ministre »
“Minister” has the meaning prescribed in regulations made by the Governor in Council.
285.01 Les définitions qui suivent s’appliquent à la présente partie.
Définitions
« employeur » Employeur qui exploite une entreprise fédérale au sens du Code canadien du travail. Y est assimilée toute personne morale constituée en vue de l’exécution d’une mission pour le compte du gouvernement du Canada.

2. Section 112 of the Public Safety Act, 2002 is amended by adding the following after subsection (1):

Section 80
(1.1) Despite subsection (1), section 80 comes into force 90 days after the day on which the bill introduced in the 2nd Session of the 39th Parliament and entitled An Act to amend the National Defence Act (definition of “employer”) and to make a consequential amendment to another Act receives royal assent, unless that section comes into force on an earlier day by order of the Governor in Council.
(1.1) Malgré le paragraphe (1), l’article 80 entre en vigueur quatre-vingt-dix jours après la date de sanction du projet de loi déposé au cours de la 2e session de la 39e législature et intitulé Loi modifiant la Loi sur la défense nationale (définition de « employeur ») et une autre loi en conséquence, sauf s’il est entré en vigueur antérieurement par décret.
