An Act to amend the National Defence Act (definition of “employer”) and to make a consequential amendment to another Act
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

NATIONAL DEFENCE ACT
1. Section 285.01 of the National Defence Act, as enacted by section 80 of chapter 15 of the Statutes of Canada, 2004, is replaced by the following:
Definitions
285.01 The following definitions apply in this Part.
“employer”
« employeur »
“employer” means an employer operating any federal work, undertaking or business as defined in the Canada Labour Code and includes any corporation established to perform any function or duty on behalf of the Government of Canada.
“Minister”
« ministre »
“Minister” has the meaning prescribed in regulations made by the Governor in Council.

PUBLIC SAFETY ACT, 2002
2. Section 112 of the Public Safety Act, 2002 is amended by adding the following after subsection (1):
Section 80
(1.1) Despite subsection (1), section 80 comes into force 90 days after the day on which the bill introduced in the 2nd Session of the 39th Parliament and entitled An Act to amend the National Defence Act (definition of “employer”) and to make a consequential amendment to another Act receives royal assent, unless that section comes into force on an earlier day by order of the Governor in Council.
