SUMMARY This enactment repeals section 67 of the Canadian Human Rights Act which provides that nothing in that Act affects any provision of the Indian Act or any provision made under or pursuant to the Indian Act. The enactment also adds an interpretative provision to the Canadian Human Rights Act in relation to complaints made under that Act against an aboriginal governmental organization.		SOMMAIRE Le texte abroge l’article 67 de la Loi canadienne sur les droits de la personne, article qui rendait cette loi sans effet sur la Loi sur les Indiens et sur les dispositions prises en vertu de cette loi. Il ajoute également une disposition interprétative à la Loi canadienne sur les droits de la personne à l’égard des plaintes présentées sous le régime de cette loi à l’encontre d’une organisation gouvernementale autochtone.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Aboriginal governmental organizations

1. The Canadian Human Rights Act is amended by adding the following after section 16:

1. La Loi canadienne sur les droits de la personne est modifiée par adjonction, après l’article 16, de ce qui :

Organisation gouvernementale autochtone

16.1 In relation to a complaint made under this Act against an aboriginal governmental organization, the needs and aspirations of the aboriginal community affected by the complaint, to the extent consistent with principles of gender equality, shall be taken into account in interpreting and applying the provisions of this Act.

16.1 Dans toute question pouvant faire, en vertu de la présente loi, l’objet d’une plainte contre une organisation gouvernementale autochtone, les besoins et les aspirations de la collectivité autochtone concernée qui sont compatibles avec les principes de l’égalité entre les sexes doivent être pris en considération pour l’interprétation et l’application des dispositions de la présente loi.

2. Section 67 of the Act is repealed.
