SUMMARY

This enactment amends the Impact Assessment Act in order to specify that a regulation must not set out a minimum coal production capacity in respect of a new coal mine in relation to which a physical activity is designated.

An Act to amend the Impact Assessment Act

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Impact Assessment Act

1Section 109 of the Impact Assessment Act is renumbered as subsection 109(1) and is amended by adding the following:

Designated physical activity — coal mines

Start of inserted block

(2)A regulation made under subsection (1) must not set out a minimum coal production capacity in respect of a new coal mine, the construction, operation, decommissioning and abandonment of which is a designated physical activity under paragraph (1)‍(b).
