The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 505, Victoria Building, the joint chairs, the Honourable Joseph A. Day and Harold Albrecht, presiding.

Representing the Senate: The Honourable Senators Day, Duncan and Mégie (3).

Representing the House of Commons: Harold Albrecht, Bob Benzen, PierreLuc Dusseault, Fayçal ElKhoury, Kent Hehr, James Maloney, Larry Miller, Michel Picard, Ramesh Sangha, Martin Shields, Scott Simms and Geng Tan (12).

In attendance: Jubilee Jackson, Joint Clerk of the Committee (House of Commons); Cynthia Kirkby, Acting Senior Counsel; Shawn Abel, Counsel, Parliamentary Information and Research Service, Library of Parliament.

Also present: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The joint chairs made a statement.

The committee considered a draft budget.

It was moved by Mr. Simms:

That the following budget application, for funding in the amount of $7,500, be approved:

The question being put on the motion, it was adopted.

In the matter of the Accessibility of Materials Incorporated by Reference (SF20151), it was agreed that counsel to the committee review its status at a later date and inform the committee of the action taken.

In the matter of the Cabinet Directive on Regulation (SF2017-2), it was agreed that the joint chairs invite the President of the Treasury Board of Canada Secretariat to appear before the committee.

In the matter of SOR/2002-164, National Capital Commission Animal Regulations, and SOR/2002-165, Regulations Amending the National Capital Commission Traffic and Property Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2015-169, Regulations Amending the Patented Medicines (Notice of Compliance) Regulations, and SOR/2017-166, Regulations Amending the Patented Medicines (Notice of Compliance) Regulations, 2017, it was agreed that the joint chairs invite the Minister of Innovation, Science and Economic Development to appear before the committee.

In the matter of SOR/2014-44, Freezing Assets of Corrupt Foreign Officials (Ukraine) Regulations, it was agreed that the joint chairs invite the Minister of Foreign Affairs to appear before the committee.

In the matter of SOR/2017-78, Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Immigration, Refugees and Citizenship with respect to certain comments made by the committee.

In the matter of SOR/96-194, Base Metal Coins Regulations, 1996, it was agreed that the joint chairs correspond with the Minister of Finance with respect to certain comments made by the committee.

In the matter of SOR/2011-262, Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Immigration, Refugees and Citizenship with respect to certain comments made by the committee.

In the matter of SOR/2016-37, Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Public Safety and Emergency Preparedness with respect to certain comments made by the committee.

In the matter of SOR/2016-38, Regulations Amending the Protection of Passenger Information Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Public Safety and Emergency Preparedness with respect to certain comments made by the committee.

In the matter of SOR/2018-140, Regulations Amending the Patent Rules and the Trade-marks Regulations, it was agreed that the file be closed.

In the matter of SOR/93-382, Prince Edward Island Cattle Marketing Levies Order, it was agreed that counsel to the committee review its status at a later date and inform the committee of the action taken.

In the matter of SOR/2001-281, By-Law No. 7 Respecting the Large Value Transfer System, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance with respect to certain comments made by the committee.

In the matter of Marginal Notes (SF2016-3), it was agreed that the file be closed.

In the matter of SOR/2008-250, Regulations Amending the Identity Screening Regulations, SOR/2011-156, Regulations Amending the Designated Provisions Regulations and the Identity Screening Regulations, and SOR/2015- 182, Regulations Amending the Designated Provisions Regulations and Repealing the Identity Screening Regulations, it was agreed that the files be closed.
