SOMMAIRE
Le projet de loi modifie la Loi sur la capitale nationale afin, notamment :
a) d’établir les limites du parc de la Gatineau;
b) de prévoir que l’intégrité écologique doit être une priorité dans la gestion du parc par la Commission de la capitale nationale (CCN);
c) d’interdire l’aliénation des terrains publics situés dans le parc, sous réserve de certaines exceptions;
d) de renforcer la consultation et la collaboration entre la CCN, la Nation algonquine Anishinabeg et les municipalités limitrophes;
e) de promouvoir le recours aux services des entreprises et des travailleurs de la Nation algonquine Anishinabeg pour les activités d’entretien et de conservation du parc de la Gatineau;
f) d’autoriser la prise de règlements pour encadrer les activités dans le parc et fixer des droits d’utilisation.
SUMMARY
The bill amends the National Capital Act to, among other things,
(a) establish the boundaries of Gatineau Park;
(b) prioritize the ecological integrity of the park in its management by the National Capital Commission (NCC);
(c) prohibit the sale of public lands located within the park, with certain exceptions;
(d) strengthen consultation and collaboration between the NCC, the Algonquin Anishinabeg Nation and neighbouring municipalities;
(e) promote the use of services from businesses and workers of the Algonquin Anishinabeg Nation for maintenance and conservation activities in Gatineau Park;
(f) authorize the creation of regulations to oversee activities in the park and set corresponding fees.

Préambule
Attendu :
que le Parlement reconnaît qu’il est essentiel de veiller à ce que l’environnement naturel de la région de la capitale nationale, et en particulier le parc de la Gatineau, soit préservé pour l’agrément de tous les Canadiens;
que le parc de la Gatineau est situé sur les terres traditionnelles non cédées de la Nation algonquine Anishinabeg;
qu’il est important de rapprocher les Canadiens du patrimoine naturel et culturel de la région de la capitale nationale et de l’histoire de ses premiers habitants autochtones, conformément à la Loi sur la Déclaration des Nations Unies sur les droits des peuples autochtones, et des autres personnes qui ont façonné ses paysages;
que la Commission de la capitale nationale a besoin des outils législatifs et réglementaires nécessaires à la gestion efficace du parc de la Gatineau;
que le parc de la Gatineau est une richesse régionale et nationale favorisant la pratique d’activités récréatives respectueuses de l’environnement, et qu’il doit être reconnu et défini comme tel;

que le gouvernement du Canada s’est engagé à renforcer la gestion efficace des zones protégées au titre du cadre mondial de la biodiversité Kunming-Montréal, adopté à Montréal le 19 décembre 2022 par la Conférence des parties à la Convention sur la diversité biologique des Nations Unies,
Preamble
Whereas Parliament recognizes that it is essential to ensure that the natural environment of the National Capital Region, and especially Gatineau Park, is preserved for the enjoyment of all Canadians;
Whereas Gatineau Park is located on the unceded traditional lands of the Algonquin Anishinabeg Nation;
Whereas it is important to connect Canadians with the natural and cultural heritage of the National Capital Region and with the history of its early Indigenous inhabitants, consistent with the United Nations Declaration on the Rights of Indigenous Peoples Act, and of others who have shaped its landscapes;
Whereas the National Capital Commission requires the legislative and regulatory tools necessary to effectively manage Gatineau Park;
Whereas Gatineau Park is a regional and national treasure promoting recreational activities respectful of the environment and must be acknowledged and defined as such;
Whereas Gatineau Park is home to diverse natural ecosystems and a significant number of plant and animal species at risk;
Whereas Parliament recognizes the importance of preserving the ecological integrity of Gatineau Park;
And whereas strengthening the effective management of protected areas is a commitment made by the government of Canada under the Kunming-Montreal Global Biodiversity Framework, adopted by the United Nations Biodiversity Conference in Montreal on December 19, 2022;

End of inserted block10.04 (1) Within 10 years after the day on which this section comes into force, the Commission shall prepare a Gatineau Park Master Plan containing a long-term ecological vision for the park, a set of ecological integrity objectives and indicators, and provisions for resource protection and restoration, zoning, visitor use, public awareness and performance evaluation, and shall cause the plan to be tabled in each House of Parliament.

(b) a federal, provincial or municipal authority if the disposal is required for the purpose of installing or maintaining public health care establishments or public infrastructure — including public utilities or transportation corridors.

Pour l’exécution de leur mission, qui est de faire respecter les dispositions de la présente loi et des règlements visant le parc de la Gatineau, ces agents de l’autorité jouissent des mêmes pouvoirs et de la même protection que la loi accorde aux agents de la paix au sens du Code criminel.
End of inserted block10.08 The Minister may designate persons or classes of persons employed in the federal public administration or by a provincial, municipal or local authority or an Algonquin Anishinabeg governing body, whose duties include law enforcement, to be enforcement officers for the purpose of enforcing the provisions of this Act or the regulations in relation to Gatineau Park. For that purpose, enforcement officers have the same powers and are entitled to the same protections provided by law to peace officers within the meaning of the Criminal Code.

(3) La Commission peut verser aux autorités compétentes, pour ceux de ses biens immeubles situés dans le Parc de la Gatineau, des subventions n’excédant pas, dans une année fiscale donnée, les montants qu’elle estime suffisants pour indemniser ces autorités des pertes de revenu de taxes municipales et scolaires subies par elles pendant l’année en question du fait de l’acquisition de ces biens par la Commission.
(3) The Commission may pay grants to the appropriate authorities in respect of real property of the Commission situated in Gatineau Park not exceeding in any tax year the amounts estimated by the Commission to be sufficient to compensate such authorities for the loss of tax revenue during that tax year in respect of municipal and school taxes by reason of the acquisition of the property by the Commission.
(2) Dans les limites indiquées au paragraphe 787(1) du Code criminel, le gouverneur en conseil peut, par règlement, fixer la peine qui peut être encourue, sur déclaration de culpabilité par procédure sommaire, pour violation de tout règlement visé au paragraphe (1).
(2) The Governor in Council may by regulation prescribe the punishment that may be imposed on summary conviction for the contravention of any regulation made under subsection (1), but the punishment so prescribed shall not exceed that set out in subsection 787(1) of the Criminal Code.
