SOMMAIRE

Le texte crée une médaille à l’intention des citoyens canadiens et des résidents permanents qui ont fait don d’au moins un de leurs organes au Canada de leur vivant.

SUMMARY

This enactment establishes a medal to be awarded to Canadian citizens and permanent residents who have donated one or more organs in Canada during their lifetime.

Préambule

Attendu :

que des milliers de Canadiens attendent actuellement des transplantations d’organes sans lesquelles leur existence est menacée, et que de telles transplantations sont rendues possibles grâce à la générosité de donneurs vivants, qui font un don de vie;

que les donneurs vivants font preuve de vertus extraordinaires — compassion, courage et dévouement envers le bien-être des autres —, et qu’ils s’exposent souvent à des risques, sans s’attendre à quoi que ce soit en retour;

qu’en plus de sauver des vies, leurs actes d’altruisme réduisent le fardeau qui pèse sur le système de soins de santé et inspirent les collectivités de partout au Canada en incarnant les plus nobles valeurs civiques et humaines;

que le Parlement souhaite instituer une médaille de reconnaissance pour les donneurs vivants afin de reconnaître et de célébrer leur acte altruiste qui sauve des vies,

Preamble

Whereas thousands of Canadians are currently awaiting life-saving organ transplants, and the generosity of living donors makes these organ transplants possible through the gift of life;

Whereas living organ donors demonstrate extraordinary compassion, courage and commitment to the well-being of others, often at personal risk and with no expectation of reward;

Whereas these acts of altruism not only save lives but also reduce the burden on the health care system and inspire communities across Canada by embodying the highest values of citizenship and humanity;

And whereas Parliament wishes to institute a Living Donor Recognition Medal to recognize and honour the altruistic and life-saving act of living organ donation;

2 The following definitions apply in this Act.

Medal means the Living Donor Recognition Medal established under section 4.‍‍ (médaille)

Minister means the member of the King’s Privy Council for Canada designated under section 3.‍ (ministre)

organ includes any form of human tissue.‍ (organe)

3 The Governor in Council may, by order, designate a member of the King’s Privy Council for Canada as the Minister for the purpose of this Act.

6 (1) Le gouverneur en conseil peut attribuer la médaille à tout citoyen canadien ou résident permanent au sens du paragraphe 2(1) de la Loi sur l’immigration et la protection des réfugiés qui a fait don d’au moins un de ses organes au Canada.

6 (1) The Governor in Council may award the Medal to any living Canadian citizen or permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who has donated one or more organs in Canada.

(2) The Medal is not to be awarded more than once to the same person.

  • a) un sénateur;

(3) The Medal is not to be awarded to any of the following persons:

  • (a) a Senator;

  • (b) a Member of Parliament;

  • (c) a person excluded by the regulations; or

  • (d) a person within a class of persons excluded by the regulations.

7 Afin de reconnaître et de promouvoir le don d’organe par des donneurs vivants, la médaille est, dans la mesure du possible, remise par un représentant du gouvernement, un sénateur ou un député dans le cadre d’une cérémonie publique.

7 In order to recognize and promote living organ donation, the Medal is to be presented to the recipient, whenever possible, by a representative of the Crown, a Senator or a Member of Parliament in a public ceremony.

8 Le gouverneur en conseil peut prendre des règlements :

  • a) qui concernent le processus de nomination des personnes à considérer pour l’attribution de la médaille;

  • b) qui déterminent les personnes ou catégories de personnes qui ne sont pas admissibles à la médaille;

  • c) qui précisent les modalités de remise de la médaille;

  • d) qui régissent l’utilisation d’initiales honorifiques par les médaillés.

8 The Governor in Council may make regulations

  • (a) respecting the process for nominating persons to be considered for award of the Medal;

  • (b) prescribing persons or classes of persons who are excluded from eligibility for the Medal;

  • (c) specifying how the Medal is to be presented; and

  • (d) providing for the use of post-nominals by recipients of the Medal.

10 Chaque année, le ministre établit un rapport indiquant le nombre de personnes qui ont reçu la médaille au cours de l’année précédente et le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant le 15 avril.

10 Every year, the Minister must prepare a report setting out the number of recipients of the Medal in the previous year and cause it to be tabled in each House of Parliament on any of the first 15 sitting days of that House after April 15.

11 (1) Le ministre, en consultation avec le Bureau du secrétaire du gouverneur général, établit un rapport sur la mise en œuvre de la présente loi et le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle ci suivant le premier anniversaire de la date d’entrée en vigueur de la présente loi.

11 (1) The Minister must, in consultation with the Office of the Secretary to the Governor General, prepare a report on the implementation of this Act and cause it to be tabled in each House of Parliament on any of the first 15 sitting days of that House after the first anniversary of the day on which this Act comes into force.

(2) If no Medals have been awarded at the time the report is prepared, the report must include reasons for the delay.
