SUMMARY

This enactment amends the Criminal Code to provide that, in imposing a sentence on an offender who is not a Canadian citizen, a court must not take into consideration the offender’s immigration status in Canada.

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Criminal Code

1The Criminal Code is amended by adding the following after section 718.‍201:

Immigration status not to be considered

718.‍202A court that imposes a sentence on an offender who is not a Canadian citizen shall not take into consideration any potential impact the sentence could have on the offender’s immigration status in Canada, or on that of a member of their family.
