SOMMAIRE

Le texte modifie la Loi sur la faillite et l’insolvabilité et la Loi sur les arrangements avec les créanciers des compagnies afin d’exclure certaines institutions publiques de leur application.

SUMMARY

This enactment amends the Bankruptcy and Insolvency Act and the Companies’ Creditors Arrangement Act to exclude certain public institutions from their application.

Bankruptcy and Insolvency Act

1 La définition de personne morale, à l’article 2 de la Loi sur la faillite et l’insolvabilité, est remplacée par ce qui suit :

1 The definition corporation in section 2 of the Bankruptcy and Insolvency Act is replaced by the following:

personne morale Personne morale qui est autorisée à exercer des activités au Canada ou qui y a un établissement ou y possède des biens, ainsi que toute fiducie de revenu. Sont toutefois exclues :

  • Insertion start a) Insertion end  les banques Insertion start et les Insertion end banques étrangères autorisées, au sens de l’article 2 de la Loi sur les banques;

  • Insertion start b) Insertion end Insertion start   Insertion end Insertion start les Insertion end compagnies d’assurance;

  • Insertion start c) Insertion end Insertion start   Insertion end Insertion start les Insertion end sociétés de fiducie;

  • Insertion start d) Insertion end Insertion start   Insertion end Insertion start les Insertion end sociétés de prêt;

  • Start of inserted block

    e) les institutions publiques qui reçoivent des subventions de fonctionnement gouvernementales et qui sont assujetties à des directives et à des procédures opérationnelles fédérales ou provinciales liées à la gouvernance, à la reddition de comptes, aux finances et à l’administration. (corporation)

    End of inserted block

corporation means a company or legal person that is incorporated by or under an Act of Parliament or of the legislature of a province, an incorporated company, wherever incorporated, that is authorized to carry on business in Canada or has an office or property in Canada or an income trust, but does not include

  • Insertion start (a) Insertion end  banks Insertion start and Insertion end authorized foreign banks within the meaning of section 2 of the Bank Act,

  • Insertion start (b) Insertion end  insurance companies,

  • Insertion start (c) Insertion end  trust companies,

  • Insertion start (d) Insertion end  loan companies, or

  • Start of inserted block

    (e) public institutions that receive government operating grants and that are subject to federal or provincial policy directives and operating procedures related to governance, accountability, finance and administration; (personne morale)

2 La définition de compagnie, au paragraphe 2(1) de la Loi sur les arrangements avec les créanciers des compagnies, est remplacée par ce qui suit :

2 The definition company in subsection 2(1) of the Companies’ Creditors Arrangement Act is replaced by the following:

compagnie Toute personne morale constituée par une loi fédérale ou provinciale ou sous son régime et toute personne morale qui possède un actif ou exerce des activités au Canada, quel que soit l’endroit où elle a été constituée, ainsi que toute fiducie de revenu. La présente définition exclut :

  • Insertion start a) Insertion end  les banques Insertion start et Insertion end les banques étrangères autorisées, au sens de l’article 2 de la Loi sur les banques;

  • Insertion start b) Insertion end  les compagnies de télégraphe;

  • Insertion start c) Insertion end  les compagnies d’assurances;

  • Insertion start d) Insertion end  les sociétés auxquelles s’applique la Loi sur les sociétés de fiducie et de prêt;

  • Start of inserted block

    e) les institutions publiques qui reçoivent des subventions de fonctionnement gouvernementales et qui sont assujetties à des directives et à des procédures opérationnelles fédérales ou provinciales liées à la gouvernance, à la reddition de comptes, aux finances et à l’administration. (company)

company means any company, corporation or legal person incorporated by or under an Act of Parliament or of the legislature of a province, any incorporated company having assets or doing business in Canada, wherever incorporated, and any income trust, but does not include

  • Insertion start (a) Insertion end  banks Insertion start and Insertion end authorized foreign banks within the meaning of section 2 of the Bank Act,

  • Insertion start (b) Insertion end  telegraph companies,

  • Insertion start (c) Insertion end  insurance companies,

  • Insertion start (d) Insertion end  companies to which the Trust and Loan Companies Act applies, Insertion start or Insertion end

  • Start of inserted block

    (e) public institutions that receive government operating grants and that are subject to federal or provincial policy directives and operating procedures related to governance, accountability, finance and administration; (compagnie)
