SOMMAIRE
Le texte modifie la Loi sur la protection des renseignements personnels afin de prévoir que les renseignements personnels qui relèvent d’une institution fédérale et qui concernent un individu accusé ou déclaré coupable d’une infraction comportant de la violence envers un partenaire intime peuvent, dans certaines circonstances, être communiqués sans le consentement de l’intéressé.
SUMMARY
This enactment amends the Privacy Act to provide that personal information under the control of a government institution that relates to an individual who has been charged with or convicted of an offence involving intimate partner violence may, in certain circumstances, be disclosed without the consent of the individual.

1 L’article 8 de la Loi sur la protection des renseignements personnels est modifié par adjonction, après le paragraphe (2), de ce qui suit :
1 Section 8 of the Privacy Act is amended by adding the following after subsection (2):
Renseignements relatifs à des accusations ou à des déclarations de culpabilité antérieures
Disclosure of information relating to prior charges or convictions
(2.1) Sous réserve des autres lois fédérales, les renseignements personnels qui relèvent d’une institution fédérale peuvent être communiqués dans la mesure où cela est nécessaire pour donner effet à toute loi ou à tout programme d’une province qui autorise la communication de renseignements concernant un individu accusé ou déclaré coupable d’une infraction comportant de la violence envers un partenaire intime au sens de l’article 2 du Code criminel.
End of inserted block(2.1) Subject to any other Act of Parliament, personal information under the control of a government institution may be disclosed to the extent that is necessary to give effect to a provincial law or program that authorizes the disclosure of information relating to an individual who has been charged with or convicted of an offence involving the use of violence by the individual against their intimate partner as defined in section 2 of the Criminal Code.
