SUMMARY

This enactment amends the Criminal Code to extend the period of time during which a warrant to obtain blood samples may be issued from four to six hours after the commission of the offence.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1This Act may be cited as the Extending the Time Limit for a Blood Sample Warrant Act (Helen’s Law).

Criminal Code

2Paragraph 256(1)‍(a) of the Criminal Code is replaced by the following:

  • (a)a person has, within the preceding Insertion start six Insertion end hours, committed, as a result of the consumption of alcohol or a drug, an offence under section 253 and the person was involved in an accident resulting in the death of another person or in bodily harm to himself or herself or to any other person, and
