An Act to amend the Criminal Code (social condition)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Criminal Code is amended by adding the following before section 718.2:
Definition of “social condition”
718.11 In section 718.2, “social condition” means, in respect of an individual, the condition of the individual experiencing social or economic disadvantage on the basis of their source of income, occupation, level of education, poverty, lack of adequate housing, homelessness or any other similar circumstance.
2. Subparagraph 718.2(a)(i) of the Act is replaced by the following:
(i) evidence that the offence was motivated by bias, prejudice or hate based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, social condition, sexual orientation or any other similar factor,
