SUMMARY
This enactment amends the Employment Insurance Act to change the way in which the qualifying period is established in the case of a work stoppage attributable to a labour dispute.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. (1) Subsection 8(2) of the Employment Insurance Act is amended by striking out “or” at the end of paragraph (c), by adding “or” at the end of paragraph (d) and by adding the following after paragraph (d):
1. (1) Le paragraphe 8(2) de la Loi sur l’assurance-emploi est modifié par adjonction, après l’alinéa d), de ce qui suit :
(e) unemployed because of a work stoppage attributable to a labour dispute at the factory, workshop or other premises at which the person was employed.
e) elle était en chômage en raison d'un arrêt de travail dû à un conflit collectif à l'usine, à l'atelier ou à tout autre local où elle exerçait un emploi.
(2) The Act is amended by adding the following after subsection 8(7):
(2) La même loi est modifiée par adjonction, après le paragraphe 8(7), de ce qui suit :
Labour dispute
(8) Despite subsection (7), the extension of a qualifying period may be equal to the duration of the period of unemployment attributable to a labour dispute at the factory, workshop or other premises at which the person was employed, provided that, for the purposes of determining the weekly rate of benefits, the qualifying period is established retrospectively to the 52 weeks preceding the beginning of the dispute.
(8) Malgré le paragraphe (7), la prolongation de la période de référence peut être égale à la durée de la période de chômage en raison d'un arrêt de travail dû à un conflit collectif à l'usine, à l'atelier ou à tout autre local où une personne exerçait un emploi, pourvu qu'aux fins de détermination du taux de prestations hebdomadaires, la période de référence soit établie rétrospectivement aux cinquante-deux semaines précédant le début du conflit.

2. This Act is deemed to have come into force on January 1, 2008.
