An Act to amend the Canada Pension Plan (pension and benefits)
R.S., c. C-8
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Canada Pension Plan is amended by adding the following after section 44:
Survivor’s pension not payable
44.1 (1) A survivor of a contributor is not entitled to receive a survivor’s pension as a result of the death of the contributor if the survivor is convicted of the murder or manslaughter of the contributor.
Death benefit not payable
(2) A survivor or child of a contributor is not entitled to receive a death benefit as a result of the death of the contributor if the survivor or child is convicted of the murder or manslaughter of the contributor.
Orphan’s benefit not payable
(3) An orphan of a contributor is not entitled to receive an orphan’s benefit as a result of the death of the contributor if the orphan is convicted of the murder or manslaughter of the contributor.
