SUMMARY This enactment amends the Criminal Code to provide that a first offence for motor vehicle theft will be proceeded with by either summary conviction or by indictment while a second or subsequent offence will be proceeded with by indictment.		SOMMAIRE Le texte modifie le Code criminel afin de prévoir qu’une première infraction de vol de véhicule à moteur soit poursuivie par procédure sommaire ou par mise en accusation, et que toute récidive soit poursuivie par mise en accusation.

An Act to amend the Criminal Code (motor vehicle theft)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. The Criminal Code is amended by adding the following after section 334:

1. Le Code criminel est modifié par adjonction, après l’article 334, de ce qui suit :

Punishment for motor vehicle theft		334.1 Every one who commits theft of a motor vehicle is
		(a) in the case of a first offence,
		(i) guilty of an offence punishable on summary conviction, or
		(ii) guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; and
		(b) in the case of a second or subsequent offence, guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.

334.1 Quiconque commet un vol de véhicule à moteur est coupable :		Vol d'un véhicule à moteur
a) dans le cas d’une première infraction :
(i) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire,
(ii) soit d’un acte criminel passible d’un emprisonnement maximal de deux ans;
b) en cas de récidive, d’un acte criminel passible d’un emprisonnement maximal de dix ans.
