An Act to amend the Special Import Measures Act (environmental costs)
R.S., c. S-15
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Paragraph 2(1.6)(b) of the Special Import Measures Act is replaced by the following:
(b) amounts that would otherwise be owing and due to the government, including fines for breaches of environmental legislation, are exempted or deducted or amounts that are owing and due to the government, including fines for breaches of environmental legislation, are forgiven or not collected;
2. Section 31 of the Act is amended by adding the following after subsection (1):
Environmental costs
(1.1) The President, when determining whether goods have been dumped, must to take into consideration the cost of implementing environmental protection measures required by an act or regulation in Canada.
3. Subsection 97(1) of the Act is amended by adding the following after paragraph (f.2):
(f.3) prescribing, for the purposes of subsection 31(1.1), the manner of calculating the cost of implementing environmental protection measures and establishing a list of acts and regulations that must be taken into account when calculating that cost;
