SUMMARY
This enactment amends the Criminal Code in relation to gaming offences in order to narrow the exemption that allows provincial governments to lawfully conduct and manage lottery schemes involving video lottery terminals and slot machines, by limiting the locations at which such machines can be installed to casinos, race-courses and betting theatres.

Le texte modifie une disposition du Code criminel relative aux loteries de façon à limiter à certains emplacements, soit les casinos, les hippodromes et les salles de paris, l’exception permettant au gouvernement d’une province de mettre sur pied et d’exploiter légalement une loterie au moyen d’appareils de loterie vidéo et d’appareils à sous.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 207(4) of the Criminal Code is amended by striking out the word “or” at the end of paragraph (b) and by adding the following after paragraph (b):
1. Le paragraphe 207(4) du Code criminel est modifié par adjonction, après l’alinéa b), de ce qui suit :
(b.1) for the purposes of paragraph (1)(a), a game that is operated on or through a video lottery terminal or slot machine, within the meaning of subsection 198(3), situated on premises other than a casino, a race-course or a betting theatre referred to in paragraph 204(8)(e); or
b.1) pour l’application de l’alinéa (1)a), les jeux qui sont exploités par un appareil de loterie vidéo ou un appareil à sous, au sens du paragraphe 198(3), et qui ne sont situés ni dans un casino, ni dans un hippodrome, ni dans une salle de paris visée à l’alinéa 204(8)e);
Coming into force
2. This Act comes into force on a day, not later than three years after the day on which it receives royal assent, to be fixed by order of the Governor in Council after the governments of the provinces and territories have been offered an opportunity by the Government of Canada to participate in consultations on its implementation.
2. La présente loi entre en vigueur — au plus tard trois ans après la date de sa sanction — à la date fixée par décret après que les gouvernements provinciaux et territoriaux se sont vu offrir par le gouvernement du Canada l’occasion de participer à des consultations portant sur sa mise en œuvre.

Clause 1: Existing text of subsection 207(4):
(4) In this section, “lottery scheme” means a game or any proposal, scheme, plan, means, device, contrivance or operation described in any of paragraphs 206(1)(a) to (g), whether or not it involves betting, pool selling or a pool system of betting other than
(a) three-card monte, punch board or coin table;
(b) bookmaking, pool selling or the making or recording of bets, including bets made through the agency of a pool or pari-mutuel system, on any race or fight, or on a single sport event or athletic contest; or
(c) for the purposes of paragraphs (1)(b) to (f), a game or proposal, scheme, plan, means, device, contrivance or operation described in any of paragraphs 206(1)(a) to (g) that is operated on or through a computer, video device or slot machine, within the meaning of subsection 198(3), or a dice game.
