SUMMARY
This enactment amends the Divorce Act to provide that, in the case of a former spouse who is terminally ill or in critical condition, the court shall make a variation order in respect of access that is in the best interests of the child.

Le texte modifie la Loi sur le divorce afin que, dans le cas d'un ex-époux malade qui est en phase terminale ou dans un état critique, le tribunal rende une ordonnance modificative relative à l'accès auprès de l'enfant qui soit dans l'intérêt de celui-ci.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 17 of the Divorce Act is amended by adding the following after subsection (5):
1. L'article 17 de la Loi sur le divorce est modifié par adjonction, après le paragraphe (5), de ce qui suit :
Variation order
(5.1) For the purposes of subsection (5), a former spouse's terminal illness or critical condition shall be considered a change of circumstances of the child of the marriage, and the court shall make a variation order in respect of access that is in the best interests of the child.
(5.1) Pour les besoins du paragraphe (5), la maladie en phase terminale ou l'état critique d'un ex-époux constitue un changement dans la situation de l'enfant à charge; le tribunal rend alors une ordonnance modificative relative à l'accès auprès de l'enfant qui est dans l'intérêt de celui-ci.
