An Act to amend the Farm Income Protection Act (crop damage by gophers)

1991, c. 22

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 4(2) of the Farm Income Protection Act is amended by adding the following after paragraph (b):

    (b.1) where a farmer's ability to use a product that has previously been commonly used to protect a crop from damage by pests is limited by law on environmental, wildlife protection, safety or other grounds, the loss that results should be compensated;

2. The Act is amended by adding the following after section 8 of the Act:

Gopher damage

8.1 An agreement that provides for a crop insurance program shall include provision for insurance for damage caused by gophers in areas where the control of gophers has been limited as a result of restrictions on the use of products that have previously been commonly used to control gophers on the grounds of environmental or wildlife protection.
