An Act to provide for the use of a maximum speed control device for use on motor vehicles and to prohibit the manufacture and sale of motor vehicles that are not equipped with a maximum speed control device

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

SHORT TITLE

Short title

1. This Act may be cited as the Maximum Speed Control Device Act.

DEFINITIONS

Definitions

2. The definitions in this section apply in this Act.

``maximum speed control device''
« régulateur de vitesse maximale »

``maximum speed control device'' means a prescribed speed control device that cuts off fuel to the engine of a motor vehicle when the speed of the motor vehicle reaches 115 kilometres an hour.

``motor vehicle''
« véhicule automobile »

``motor vehicle'' means any vehicle designed to be driven or drawn on roads by any means other than exclusively by muscular power, and includes pedal cycles with auxiliary motors, minibikes and motorized snow vehicles, but does not include

      (a) any vehicle designed for running exclusively on rails;

      (b) a vehicle used by peace officers;

      (c) a vehicle used by firefighters or fire prevention officers;

      (d) ambulances; or

      (e) a prescribed vehicle.

PROHIBITIONS

Prohibitions

3. A person shall not

    (a) manufacture, in Canada, a motor vehicle that is not equipped with a maximum speed control device for the purpose of selling it in Canada;

    (b) sell, in Canada, a motor vehicle, imported into Canada after the coming into force of this paragraph, unless the vehicle has been equipped with a maximum speed control device;

    (c) knowingly remove and render inoperative a maximum speed control device installed on a motor vehicle, after the coming into force of this paragraph, nor reduce its operating capacity where the person knows or has reasonable grounds to believe that the motor vehicle will be used

      (i) without being equipped with a maximum speed control device, or

      (ii) when the maximum speed control device does not operate correctly or is inoperative; or

    (d) drive a motor vehicle sold in Canada, after the coming into force of this Act, with a maximum speed control device where the person knows or has reasonable grounds to believe that the maximum speed control device has been removed, does not operate correctly or is inoperative.

OFFENCES AND PENALTIES

Offences and penalty

4. Everyone who contravenes paragraph 3(a) or (b) is guilty of an offence and liable on summary conviction to a fine not exceeding fifty thousand dollars.

5. Everyone who contravenes paragraph 3(c) or (d) is guilty of an offence and liable on summary conviction to a fine not exceeding ten thousand dollars.

REGULATIONS

Regulations

6. The Governor in Council may make regulations

    (a) defining a speed control device for the purposes of this Act; and

    (b) providing for exceptions to the definition of ``motor vehicle''.

Coming into force

7. This Act shall come into force one year after the day on which it is assented to.
