An Act to amend the Land Titles Act (age of majority and definition of ``infant'')

Preamble

WHEREAS, on November 20, 1989, the Convention on the Rights of the Child was adopted by the United Nations General As sembly;

WHEREAS the Convention was ratified by Canada on December 31, 1991;

WHEREAS the Convention proposes a def inition of ``child'' that should be applied uni formly throughout federal legislation;

AND WHEREAS the age of majority and the definition of ``infant'' should be consistent with the definition of ``child'';

NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as fol lows:

1. Section 2 of the Land Titles Act is amended by adding the following in alpha betical order:

``infant''
« mineur »

``infant'' means a person under eighteen years of age and ``infancy'' has a corresponding meaning;

2. Section 198 of the Act is replaced by the following:

Proof of majority of transferor etc.

198. The registrar may require evidence that any person making a transfer, mortgage, encumbrance or lease is of the full age of eighteen years.

3. The Act is amended by replacing the expression ``full age of nineteen years'', where it occurs in Forms 7, 25 and 29, with the expression ``full age of eighteen years''.
