RECOMMENDATION

His Excellency the Governor General recommends to the House of Commons the appropriation of public revenue under the circumstances, in the manner and for the purposes set out in a measure entitled ``An Act to establish the Canadian Parks Agency and to amend other Acts as a consequence''.

SUMMARY

This enactment establishes the Canadian Parks Agency and provides for the human resource, financial and administrative authorities by which the Agency administers national parks, national historic sites, other protected heritage areas and related programs, subject to the overall direction of the Minister of Canadian Heritage.

EXPLANATORY NOTES

Appropriation Act No. 3, 1993-94

Clause 47: Environment Vote 21b is replaced by section 3 of the Revolving Funds Act, as proposed by clause 61.

Appropriation Act No. 4, 1995-96

Clause 48: Canadian Heritage Vote 27b is replaced by section 3.1 of the Revolving Funds Act, as proposed by clause 61.

Historic Sites and Monuments Act

Clause 51: Section 6 reads as follows:

6. (1) The Minister may designate an officer of the Department of Canadian Heritage to be the Secretary of the Board, or appoint a Secretary of the Board at such remuneration and under such terms or conditions of employment as may be prescribed by the Governor in Council.

(2) The Minister may, from among the persons employed in the Department of Canadian Heritage, provide the Board with such other employees or assistants as are necessary for the proper conduct of the business of the Board.

Laurier House Act

Clause 52: (1) Subsection 2(1) reads as follows:

2. (1) The Dominion Archivist, subject to subsection (2), has the care, custody and control of Laurier House (more particularly described in the First Schedule) and the contents thereof and shall administer the house and its contents in accordance with the desires and purposes expressed in the late Mr. King's Will (the relevant portion of which is set out in the Second Schedule).

(2) Subsection 2(3) reads as follows:

(3) An officer to be known as the Curator of Laurier House, and to be responsible, under the Dominion Archivist, for the administration of Laurier House, may be appointed in accordance with the provisions of the Civil Service Act after the termination of the employment of the first such officer who shall be appointed and whose salary shall be fixed by the Governor in Council.

Clause 53: Section 4 reads as follows:

4. The Dominion Archivist may consult the Historic Sites and Monuments Board with references to the performance of his duties under this Act.

National Parks Act

Clause 55: The definitions ``park warden'' and ``superintendent'' in section 2 read as follows:

``park warden'' means an officer appointed under the Public Service Employment Act whose duties include the enforcement of this Act;

``superintendent'' means an officer appointed under the Public Service Employment Act and holding the office of superintendent of a park, and includes any person appointed under that Act who is authorized by such an officer to act on the officer's behalf.

Clause 56: Subsection 5(2.1) reads as follows:

(2.1) Officers and classes of officers appointed under the Public Service Employment Act and designated by the Minister may exercise the powers of and are entitled to the protection provided by law to peace officers in the enforcement of this Act.

Public Service Staff Relations Act

Clause 58 : New. The relevant portion of the definition ``employee'' in subsection 2(1) reads as follows:

``employee'' means a person employed in the Public Service, other than
