An Act to amend the Agreement on Internal Trade Implementation Act

1996, c. 17

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Agreement on Internal Trade Implementation Act is amended by adding the following after section 9:

Deemed approval by all provinces

9.1 Where a proposal, made pursuant to the Agreement, relating to

    (a) the regulation of trade and commerce within the meaning of that phrase as used in section 91 of the Constitution Act, 1867, and

    (b) the avoidance of infringement of section 121 of the Constitution Act, 1867

receives the approval of at least two thirds of the provinces that have, in the aggregate, according to the then latest general census, at least fifty per cent of the population of all the provinces, but does not receive the approval of all provinces, the Governor in Council may, by order, bring the proposal or a part of it specified in the order in force, and the proposal or part of it so specified shall, for all purposes, including suspending benefits or the taking of retaliatory measures under section 9, be deemed to be in force under the Agreement as if it had been approved by all provinces.
