SUMMARY

This enactment implements the provisions of the land claim settlement agreement with the Yukon first nations and, in respect of certain lands in the Yukon, with the Tetlit Gwich'in, that give certain dispute-resolution functions to a new board.

The enactment establishes the Board, providing for up to eleven members to be appointed by the Minister, one half, excluding the Chairperson, on the nomination of the Council for Yukon Indians. The Board is independent of government but is to be funded by the federal government.

Persons applying to the Board for an order must have first attempted to resolve their dispute by negotiation. Among the types of orders the Board has the authority to issue are the following:

- an access order setting the terms and conditions, including compensation, in respect of those rights of access across Yukon first nation or Tetlit Gwich'in settlement lands that require either consent of the aboriginal owner or an order of the Board;

- an order setting general terms and conditions, additional to any described in the settlement agreement, in respect of rights of access across settlement lands that do not require consent of the aboriginal owner; and

- an order resolving a dispute between an owner or occupant of non-settlement land and a person with a mineral right respecting the interpretation of the right of the mineral right holder to access the land.
