SUMMARY

This enactment replaces the Migratory Birds Convention Act, which was passed in 1917 to implement the Migratory Birds Covention between Canada and the United States. That Act regulated the hunting and use of migratory birds and prohibited trafficking and commercialization of them. It also provided for the establishment of migratory bird sanctuaries.

This enactment modernizes the language of the original Act and clarifies its scope. It is also binding on Her Majesty, both federally and provincially, and provides enhanced regulatory authority to implement the Convention and recover administrative costs. It updates and strengthens the enforcement provisions relating to game officers, inspections, searches, seizures, abandonment, forfeiture and disposal of property. It also provides for the publication of amendments to the Convention.

Finally, provision is made for issuing tickets for alleged offences. Penalties for offences are increased and courts are given increased authority to make sentencing orders.
