This enactment amends the Canada Elections Act to prohibit foreign contributions to third parties for election advertising purposes.

An Act to amend the Canada Elections Act (foreign contributions)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Canada Elections Act

1Subsection 363(2) of the Canada Elections Act is replaced by the following:

Prohibition — third party

(1.‍1)No person or entity referred to in paragraphs 358(a) to (e) shall make a contribution to a third party for election advertising purposes.

Return of contributions

(2)If a registered party, a registered association, a nom­ination contestant, a candidate, a leadership contestant Insertion start or a third party Insertion end receives a contribution from an ineligible contributor, the chief agent of the registered party, the financial agent of the registered association, the official agent of the candidate, the financial agent of the nomination contestant or leadership contestant or Insertion start the official representative of the third party Insertion end , as the case may be, shall, within 30 days after becoming aware of the ineligibility, return the contribution unused to the contributor or, if that is not possible, pay the amount of it — or, in the case of a non-monetary contribution, an amount of money equal to its commercial value — to the Chief Electoral Officer, who shall forward that amount to the Receiver General.‍

2Section 370 of the Act is amended by adding the following after subsection (1):

(1.‍1)No person or entity referred to in paragraphs 358(a) to (e) shall make a contribution to a third party for election advertising purposes that comes from money, property or the services of another person or entity that was provided to that person or entity for that purpose.

Coordinating Amendment

Bill C-76

3If Bill C-76, introduced in the 1st session of the 42nd Parliament and entitled An Act to amend the Canada Elections Act and other Acts and to make certain consequential amendments, receives royal assent, then, on the first day on which both section 231 of that Act and section 1 of this Act are in force,

  • (a)subsection 363(1.‍1) of the Canada Elections Act is replaced by the following:

    Prohibition — third party

    (1.‍1)No foreign entity referred to in paragraphs 358(a) to (e) shall make a contribution to a third party for the purpose of an election advertising message.

  • (b)subsection 370(1.‍1) of the Act is replaced by the following:

    Prohibition — third party

    (1.‍1)No foreign entity referred to in paragraphs 358(a) to (e) shall make a contribution to a third party for an election advertising message that comes from money, property or the services of another person or entity that was provided to that person or entity for that purpose.
