SUMMARY

This enactment amends the Criminal Code to require that a presentence report contain information on any aspect of the offender’s mental condition that is relevant for sentencing purposes.

An Act to amend the Criminal Code (presentence report)

R.‍S.‍, c. C-46

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1Subsection 721(3) of the Criminal Code is amended by adding the following after paragraph (a):

  • (a.‍1)any Insertion start aspect of Insertion end the offender’s mental Insertion start condition that is relevant for sentencing purposes, Insertion end as well as any mental health Insertion start services or support Insertion end available to Insertion start the offender Insertion end ;
