SUMMARY

This enactment amends the Firearms Act to eliminate the expiry of certain firearms licences and to provide for the relinquishment of licences. It also requires individuals to update their licence application information every 10 years and provides for the suspension of licences in certain circumstances.

An Act to amend the Firearms Act (licences)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Firearms Act

1Section 25 of the Firearms Act is replaced by the following:

Authorization to transfer ammunition to individuals

25A person may transfer ammunition that is not prohibited to an individual only if the individual holds a licence authorizing Insertion start the possession of Insertion end firearms Insertion start and that licence is not suspended at the time of the transfer Insertion end .

2Subparagraph 27(a)‍(i) of the Act is replaced by the following:

  • (i)whether the transferee or individual holds a licence Insertion start that is not suspended Insertion end ,

3(1)Subsections 64(1) and (1.‍1) of the Act are replaced by the following:

Term of licences

64(1)A licence that is issued to an individual who is eighteen years old or older Insertion start does not expire Insertion end .

(2)Subsection 64(7) of the Act is repealed.

4The Act is amended by adding the following after section 67:

67.‍1The holder of a licence may relinquish their licence to a chief firearms officer in the prescribed manner.

67.‍2The holder of a licence shall, every ten years, provide a chief firearms officer with the prescribed information referred to in subsection 54(1) in the prescribed manner.

67.‍3(1)The licence of a holder who fails to comply with section 67.‍2 is suspended.

(2)The chief firearms officer shall give notice of the suspension to the holder of the licence.

(3)The suspension is cancelled as soon as the holder complies with section 67.‍2.

5Section 70 of the Act is amended by adding the following after subsection (1):

(1.‍1)No licence shall be revoked under subsection (1) solely because it is suspended.

6Paragraph 117(j.‍1) of the Act is repealed.

7Subsection 64(1) of the Firearms Act, as enacted by section 3, also applies to a licence that was issued in the five-year period immediately before the day on which this section comes into force and that has not been revoked.

Coordinating Amendments

8(1)In this section, other Act means the Common Sense Firearms Licensing Act.

(2)If section 14 of the other Act comes into force before section 3 of this Act, then subsections 64(1.‍1) to (1.‍4) of the Firearms Act are repealed.

(3)If section 3 of this Act comes into force before section 14 of the other Act, then that section 14 is repealed.

(4)If section 14 of the other Act comes into force on the same day as section 3 of this Act, then that section 14 is deemed never to have come into force and is repealed.
