SUMMARY

This enactment amends the Privacy Act to provide that personal information under the control of a government institution that relates to an individual who has been charged with or convicted of an offence involving intimate partner violence may, in certain circumstances, be disclosed without the consent of the individual.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Privacy Act

1Section 8 of the Privacy Act is amended by adding the following after subsection (2):

Disclosure of information relating to prior charges or convictions

(2.‍1)Subject to any other Act of Parliament, personal information under the control of a government institution may be disclosed to the extent that is necessary to give effect to a provincial law or program that authorizes the disclosure of information relating to an individual who has been charged with or convicted of an offence involving the use of violence by the individual against their intimate partner as defined in section 2 of the Criminal Code.
