Amendments to the Canadian Polar Commission Act

65. Subsection 6(1) of the Canadian Polar Commission Act is replaced by the following:

Management of activities of the Commission

6. (1) The activities of the Commission shall be managed by a Board of Directors consisting of up to seven members, including a Chairperson and a Vice-Chairperson , to be appointed by the Governor in Council, on the recommendation of the Minister.

66. Section 9 of the Act is replaced by the following:

Remunera-
tion

9. (1) The Chairperson and the Vice-Chairperson shall be paid any remuneration that is fixed by the Governor in Council.

Remunera-
tion for other members

(2) The members of the Board, other than the Chairperson and the Vice-Chairperson , shall be paid any remuneration that is fixed by the Governor in Council for their attendance at any meetings of the Board, or of any of its committees, that the Chairperson directs them to attend, and for any special work for the Commission performed by them at the request of the Chairperson.

67. Section 12 of the Act is replaced by the following:

Absence of Chairperson

12. In the event of the absence or incapacity of the Chairperson, the Vice-Chairperson shall be designated by the Board to exercise all of the powers and perform all of the duties and functions of the Chairperson.

68. Section 15 of the Act is replaced by the following:

Meetings

15. (1) Subject to subsection (2), the Board shall meet at least three times in each year, at different places in Canada, at any times and places that the Chairperson may select.

Northern meetings

(2) At least two of the Board's meetings in each year shall be held in a polar region in Canada .

Amendments to the Canadian Race Relations Foundation Act

69. (1) Paragraph 4(a) of the English version of the Canadian Race Relations Foundation Act is replaced by the following:

    (a) undertaking research and collecting data and developing a national information base in order to further understanding of the nature of racism and racial discrimination and thereby assisting business, labour, voluntary, community and other organizations as well as public institutions, governments, researchers and the general public to eliminate racism and racial discrimination;

(2) Paragraphs (4)(b) to (g) of the Act are replaced by the following:

    (b) acting as a clearing-house that provides data about race relations, establishes links with public, private and educational institutions and libraries and facilitates the exchange of information that would assist governments to develop effective race relations policies and practices ;

    (c) supporting effective race relations training by providing appropriate information and assisting in the development of professional standards; and

    (d) disseminating appropriate information to increase public awareness of the importance of eliminating racism and racial discrimination;

70. Subsection 6(1) of the Act is replaced by the following:

Board of Directors

6. (1) The activities of the Foundation shall be managed by a Board of Directors consisting of a Chairperson and not more than fifteen other directors to be appointed by the Governor in Council, on the recommendation of the Minister, after the Minister, taking into account the multicultural character, linguistic duality and regional diversity of Canadian society, has consulted with such governments, institutions, organizations and individuals as the Minister considers appropriate.

71. Subsection 17(3) of the Act is replaced by the following:

Application of Financial Adminis-
tration Act

(3) The following provisions of the Financial Administration Act do not apply in respect of the Foundation:

    (a) sections 89 and 89.1;

    (b) Division II of Part X, other than sections 109 and 119;

    (c) section 121;

    (d) sections 123 and 124;

    (e) subsection 131(3);

    (f) section 134;

    (g) sections 138 to 142; and

    (h) Division IV of Part X.

Inconsistency with Financial Adminis-
tration Act

(4) In the event of any inconsistency between this Act and the Financial Administration Act, this Act prevails to the extent of the inconsistency.

72. Section 20 of the Act is replaced by the following:

Delegation

20. The Minister may delegate any of the Minister's powers, duties and functions under this Act to any Minister of State appointed pursuant to the Ministries and Ministers of State Act to assist the Minister.

73. Section 23 of the Act is repealed.

74. The heading before section 26 of the English version of the Act is replaced by the following:

Amendments to the Canadian Radio-television and Telecommunications Commission Act

79. (1) The definitions ``Chairman'' and ``Vice-Chairman'' in section 2 of the English version of the Canadian Radio-television and Telecommunications Commission Act are repealed.

(2) Section 2 of the English version of the Act is amended by adding the following in alphabetical order:

6. (1) The Governor in Council shall designate one of the full-time members to be Chairperson of the Commission and two of the full-time members to be Vice-Chairpersons of the Commission.

(2) The Chairperson is the chief executive officer of the Commission, has supervision over and direction of the work and staff of the Commission and shall preside at meetings of the Commission.

(3) In the event of the absence or incapacity of the Chairperson or if the office of Chairperson is vacant, the Commission may authorize one of the Vice-Chairpersons to exercise the powers and to perform the duties and functions of the Chairperson .

(4) The Commission may authorize one or more of its full-time members to act as Chairperson for the time being if the Chairperson and both Vice-Chairpersons are absent or unable to act or if the office of Chairperson and each office of Vice-Chairperson are vacant.

81. Subsection 7(1) of the Act is replaced by the following:

(1) Each full-time member shall be paid remuneration to be fixed by the Governor in Council and each part-time member shall be paid any fees for attendances at meetings of the Commission or any committee of the Commission or at any public hearing before the Commission that the part-time member is requested by the Chairperson to attend that are fixed by by-law of the Commission.

82. Subsection 9(2) of the Act is replaced by the following:

(2) The members of the Commission are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada for the purposes of any regulations made pursuant to section 9 of the Aeronautics Act.

83. Subparagraph 11(1)(c)(i) of the Act is replaced by the following:

      (i) the fees to be paid to part-time members for attendances at meetings of the Commission or any committee of the Commission or at public hearings before the Commission that they are requested by the Chairperson to attend, and

84. Subsection 12(2) of the English version of the Act is replaced by the following:

(2) The full-time members of the Commission and the Chairperson shall exercise the powers and perform the duties vested in the Commission and the Chairperson , respectively, by the Telecommunications Act or by any Special Act within the meaning of that Act.

Canadian Transportation Accident Investigation and Safety Board

Amendments to the Canadian Transportation Accident Investigation and Safety Board Act

85. (1) Subsection 4(1) of the Canadian Transportation Accident Investigation and Safety Board Act is replaced by the following:

4. (1) There is hereby established a board to be known as the Canadian Transportation Accident Investigation and Safety Board, consisting of not more than five members appointed by the Governor in Council.

(2) Subsections 4(6) and (7) of the Act are replaced by the following:

(6) A full-time member shall be paid any remuneration and a part-time member shall be paid any fees that are fixed by the Governor in Council.

Expenses

(7) The members are entitled to be paid reasonable travel and living expenses incurred by them in the course of their duties under this Act while absent from, in the case of full-time members, their ordinary place of work and, in the case of part-time members, their ordinary place of residence.

Retirement pensions

(8) The full-time members are deemed to be employed in the Public Service for the purposes of the Public Service Superannuation Act.

Compensa-
tion

(9) The members are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada for the purposes of any regulations made pursuant to section 9 of the Aeronautics Act.

Conditional Amendment

Bill S-2

86. If Bill S-2, introduced in the first session of the thirty-sixth Parliament and entitled An Act to amend the Canadian Transportation Accident Investigation and Safety Board Act and to make a consequential amendment to another Act, is assented to and section 3 of that Act comes into force before section 85 of this Act, then section 85 is repealed.
