SUMMARY
This enactment amends the provisions of the Employment Insurance Act that allow for qualifying periods and benefit periods to be extended as the result of time spent by the claimant in a jail, penitentiary or other similar institution so that they apply only if the claimant is not found guilty of the offence for which he or she was being held or any other offence arising out of the same transaction.

Le texte modifie les dispositions de la Loi sur l’assurance-emploi qui permettent la prolongation de la période de référence et de la période de prestations d’un prestataire ayant été détenu dans une prison, un pénitencier ou une autre institution de même nature de sorte qu'elles ne s'appliquent au prestataire que s'il n'est pas déclaré coupable de l'infraction pour laquelle il était détenu ni de toute autre infraction se rapportant à la même affaire.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Paragraph 8(2)(b) of the Employment Insurance Act is replaced by the following:
1. L’alinéa 8(2)b) de la Loi sur l’assurance-emploi est remplacé par ce qui suit :
(b) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the person was being held or any other offence arising out of the same transaction;
b) elle était détenue dans une prison, un pénitencier ou une autre institution de même nature et n’a pas été déclarée coupable de l’infraction pour laquelle elle était détenue ni de toute autre infraction se rapportant à la même affaire;
2. Paragraph 10(10)(a) of the Act is replaced by the following:
2. L’alinéa 10(10)a) de la même loi est remplacé par ce qui suit :
(a) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the claimant was being held or any other offence arising out of the same transaction;

4. Paragraphs 10(10)(a) and 152.11(11)(a) of the Employment Insurance Act, as enacted by sections 2 and 3, respectively, do not apply to the benefit period of a claimant or a self-employed person, as the case may be, in respect of any week for which the claimant or the self-employed person was confined in a jail, penitentiary or other similar institution before the coming into force of this Act.
4. Les alinéas 10(10)a) et 152.11(11)a) de la Loi sur l’assurance-emploi, édictés par les articles 2 et 3, ne s’appliquent pas à la période de prestations du prestataire ou du travailleur indépendant, selon le cas, à l’égard de toute semaine pendant laquelle il était détenu dans une prison, un pénitencier ou un autre établissement semblable avant l’entrée en vigueur de la présente loi.

Coming into force
5. This Act comes into force on the first Sunday after the day on which it receives royal assent.
