Bill S-37

SUMMARY

This enactment amends the Criminal Code to prohibit certain offences, including theft, robbery, mischief and arson against cultural property protected under the 1954 Convention for the Protection of Cultural Property in the Event of Armed Conflict. Those amendments allow for the prosecution of such offences when committed outside Canada by Canadians.

It also amends the Cultural Property Export and Import Act to prohibit Canadians from illegally exporting or otherwise removing protected cultural property from an occupied territory. Those amendments allow for the prosecution of such offences when committed outside Canada by Canadians and provide for a mechanism for the restitution of cultural property.

SOMMAIRE

Le texte modifie le Code criminel pour interdire notamment le vol, le vol qualifié, les méfaits et les incendies criminels touchant les biens culturels protégés aux termes de la Convention pour la protection des biens culturels en cas de conflit armé (1954). Il prévoit aussi le pouvoir de poursuivre tout Canadien qui commet une telle infraction à l’étranger.

Il modifie également la Loi sur l’exportation et l’importation de biens culturels pour interdire l’exportation ou le retrait illégaux par un Canadien de biens culturels protégés d’un territoire occupé. Finalement, le texte prévoit le pouvoir de poursuivre tout Canadien qui commet une telle infraction à l’étranger et prévoit un mécanisme de restitution de biens culturels.
