An Act to Amend the Criminal Code (recruitment of children and swarming)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Criminel Code is amended by adding the following after section 264:

264.01 (1) Every person who recruits a child to commit an offence under this or any other Act of Parliament, is guilty of

    (a) an indictable offence and liable to imprisonment for a term not exceeding five years; or

    (b) an offence punishable on summary conviction.

(2) In subsection (1), ``child'' means a person who is or appears to be under the age of eighteen years.

264.02 (1) Every person who engages in swarming is guilty of

    (a) an indictable offence and liable to imprisonment for a term not exceeding five years; or

    (b) an offence punishable on summary conviction.

(2) The Minister of Justice shall, not later than two months after this Act is assented to, define by regulation what constitutes ``swarming'' for the purposes of subsection (1).
