Le texte modifie la Loi sur la Banque de l’infrastructure du Canada afin de recentrer la mission de la Banque et de prévoir qu’elle doit accorder la priorité à certains investissements et certains projets d’infrastructures.

SUMMARY

This enactment amends the Canada Infrastructure Bank Act to refocus the purpose of the Bank and to provide that it must give priority to certain investments and infrastructure projects.

1 L’article 6 de la Loi sur la Banque de l’infrastructure du Canada est remplacé par ce qui suit :

6 La Banque a pour mission de faire des investissements dans des projets d’infrastructures situés au Canada ou en partie au Canada qui sont dans l’intérêt public, par exemple en soutenant des conditions favorables à l’atténuation des changements climatiques ou à l’adaptation à ceux-ci ou en contribuant à la viabilité de l’infrastructure au Canada.

6 The purpose of the Bank is to invest in infrastructure projects in Canada or partly in Canada that are in the public interest by, for example, supporting conditions that foster climate change mitigation or adaptation, or by contributing to the sustainability of infrastructure in Canada.

2 (1) Les alinéas 7(1)b) et c) de la même loi sont remplacés par ce qui suit :

2 (1) Paragraphs 7(1)‍(b) and (c) of the Act are replaced by the following:

b) investir dans des projets d’infrastructures, notamment au moyen de véhicules financiers innovateurs;

(1.‍1) Dans l’exercice des fonctions prévues au paragraphe (1), la Banque accorde la priorité :

a) aux investissements des institutions publiques, des différents ordres de gouvernement et des collectivités autochtones et du Nord;

b) aux projets d’infrastructures qui proposent des mesures visant à atténuer les changements climatiques ou à s’y adapter;

c) aux projets d’infrastructures qui ne portent pas atteinte à l’environnement.

(1.‍1) In carrying out the functions set out in subsection (1), the Bank must give priority to:

(a) investments from public institutions, all levels of governments and Northern and Indigenous communities;

(b) infrastructure projects that propose measures aimed at mitigating or adapting to climate change; and

27.‍1 (1) La Banque soumet annuellement au ministre désigné un rapport sur les investissements et les projets d’infrastructures auxquels la priorité a été accordée au titre du paragraphe 7(1.‍1).

27.‍1 (1) The Bank must annually submit a report to the designated Minister on the investments and infrastructure projects to which priority was given under subsection 7(1.‍1).

(2) The designated Minister must table the report before each House of Parliament on any of the first 15 days on which that House is sitting after the designated Minister receives it.

28 (1) Subject to subsection (2), all information obtained by the Bank, by any of the Bank’s subsidiaries or by any of the subsidiaries of the Bank’s wholly-owned subsidiaries in relation to the proponents of infrastructure projects is privileged and a director, officer, employee, or agent or mandatary of, or adviser or consultant to, the Bank, any of its subsidiaries, or any of the subsidiaries of its wholly-owned subsidiaries must not knowingly communicate, disclose or make available the information, or permit it to be communicated, disclosed or made available.
