SUMMARY

This enactment amends the Copyright Act to allow a person, in certain circumstances, to circumvent a technological protection measure to make a computer program interoperable with any device or component, or with a product they manufacture.

An Act to amend the Copyright Act (interoperability)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Copyright Act

1Subsection 41.‍12(1) of the Copyright Act is replaced by the following:

Interoperability

41.‍12(1)Paragraph 41.‍1(1)‍(a) does not apply to a person who

  • Insertion start (a) Insertion end owns a computer program or a copy of one, or has a licence to use the program or copy, and who circumvents a technological protection measure that protects that program or copy for the purpose of obtaining information Insertion start and allowing Insertion end the person to make the program Insertion start or a device in which it is embedded Insertion end interoperable Insertion start with Insertion end any other computer program, Insertion start device or component; or Insertion end

  • Start of inserted block

    (b)manufactures a product and circumvents a technological protection measure that protects a computer program embedded in another product for the sole purpose of allowing the person to make the computer program, or a device in which it is embedded, interoperable with the manufactured product.
