SUMMARY

This enactment amends the Parliament of Canada Act to provide that Parliament is not to be prorogued for more than a specified number of days or during certain periods.

An Act to amend the Parliament of Canada Act (prorogation)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Parliament of Canada Act

1The Parliament of Canada Act is amended by adding the following after section 3:

Prorogation

Timing of prorogation

Start of inserted block

3.‍1Parliament shall not be prorogued

  • (a)for more than 10 days that are, according to the calendar for the year tabled in the House of Commons under the Standing Orders of the House of Commons, projected to be sitting days of that House;

  • (b)more than once during any 12-month period after the beginning of a session of Parliament; or

  • (c)between the day on which the estimates of the government are tabled in the House of Commons and the final day of the period allotted to the consideration of those estimates by that House.
