CHAPTER 42
An Act to amend the Eastern Synod of the Evangelical Lutheran Church in Canada Act
[Assented to 9th December, 2014]
Preamble
Whereas the Eastern Synod of the Evangelical Lutheran Church in Canada has, by its petition, represented that
(a) the corporation, having its head office in the City of Kitchener, in the Province of Ontario, was incorporated as a Synod by an Act of Parliament of Canada, being chapter 32 of the Statutes of Canada, 1885, entitled An Act to incorporate the Synod of the Evangelical Lutheran Church of Canada under the name The Evangelical Lutheran Synod of Canada;
(b) the name of the Synod was changed to the Eastern Canada Synod of the Lutheran Church in America by chapter 64 of the Statutes of Canada, 1963;
(c) the Act of incorporation has since been amended from time to time and was repealed and replaced by chapter 50 of the Statutes of Canada, 1990, the Eastern Synod of the Evangelical Lutheran Church in Canada Act, in which the Synod was continued as a corporation named the Eastern Synod of the Evangelical Lutheran Church in Canada; and
(d) the corporation wishes that the Eastern Synod of the Evangelical Lutheran Church in Canada Act be amended so that it may continue to call regular and special meetings under that Act despite certain provisions of the Canada Not-for-profit Corporations Act;
And whereas the petitioner has, by its petition, prayed that it be enacted as hereinafter set forth, and it is expedient to grant the prayer of the petition;

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 12 of the Eastern Synod of the Evangelical Lutheran Church in Canada Act is replaced by the following:
Canada Not-for-profit Corporations Act
12. Despite section 294 of the Canada Not-for-profit Corporations Act, subsections 160(1) and 168(1) of that Act do not apply to the Corporation.
