CONDITIONAL AMENDMENTS

Bill C-23

96. If Bill C-23, introduced in the 2nd Session of the 36th Parliament and entitled the Modernization of Benefits and Obligations Act, receives royal assent,

    (a) subsection 45(2.1) of the Pension Act, as enacted by subsection 219(1) of the Modernization of Benefits and Obligations Act, is replaced by the following:

Pensions for surviving common-law partners

(2.1) Except as otherwise provided in this Act, the surviving common-law partner of a member of the forces who was, at the time of the member's death, in receipt of a pension paid at a rate set out in one of classes one to eleven of Schedule I is entitled to a pension in accordance with the rate for a survivor set out in Schedule II, regardless of the cause of that member's death, but no payment shall be made under this subsection from a date prior to that from which pension is payable in accordance with section 56.

    (b) section 222 of the Modernization of Benefits and Obligations Act is repealed.

Bill C-35

97. If Bill C-35, introduced in the 2nd Session of the 36th Parliament and entitled the Canada Shipping Act, 2000 (in this section referred to as the ``other Act''), is assented to, then

    (a) on the later of the coming into force of paragraph 6.6(b) of the Department of Veterans Affairs Act, as enacted by section 16 of this Act, and section 1 of the other Act, the reference in that paragraph 6.6(b) to the ``Canada Shipping Act'' is replaced by a reference to the ``Canada Shipping Act, 2000'';

    (b) on the later of the coming into force of paragraph 109.1(b) of the Pension Act, as enacted by section 41 of this Act, and section 1 of the other Act, the reference in that paragraph 109.1(b) to the ``Canada Shipping Act'' is replaced by a reference to the ``Canada Shipping Act, 2000''; and

    (c) on the later of the coming into force of paragraph 30(1.1)(b) of the War Veterans Allowance Act, as enacted by section 84 of this Act, and section 1 of the other Act, the reference in that paragraph 30(1.1)(b) to the ``Canada Shipping Act'' is replaced by a reference to the ``Canada Shipping Act, 2000''.

REPEALS

Repeal

98. The Canadian Patriotic Fund Act, 1939, chapter 1 of the Statutes of Canada, 1939-40, is repealed.

Repeal

99. The Army Benevolent Fund Act, chapter A-16 of the Revised Statutes of Canada 1970, is repealed.

Repeal of R.S., c. C-28

100. The Children of Deceased Veterans Education Assistance Act is repealed.

COMING INTO FORCE

Coming into force

101. The provisions of this Act, other than sections 96 and 97, and the provisions of any Act as enacted by this Act, come into force on a day or days to be fixed by order of the Governor in Council.
