An Act to amend the Employment Insurance Act

1996, c. 23; 1997, c. 26

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. (1) Subsection 5(2) of the Employment Insurance Act is amended by striking out the word ``and'' at the end of paragraph (h) and by adding the following after paragraph (h):

    (h.1) employment of a person in connection with a barbering or hairdressing establishment, where that person

      (i) provides any of the services that are normally provided therein,

      (ii) is not the owner or proprietor thereof,

      (iii) has a written lease in respect of the establishment with the owner or proprietor thereof,

      (iv) uses tools owned by that person in providing the services described in subparagraph (i),

      (v) has exclusive control over the prices charged for the services described in subparagraph (i) that are provided by that person,

      (vi) has exclusive control over the number of hours worked by that person in providing the services described in subparagraph (i),

      (vii) has exclusive control over all income from the services described in subparagraph (i) that are provided by that person, and

      (viii) receives no remuneration from the owner or proprietor thereof for the services described in subparagraph (i) that are provided by that person; and

(2) The Act is amended by adding the following after subsection 5(5):

Exception

(5.1) Notwithstanding subsections (4) and (5), the Commission may not make regulations for including in insurable employment employment excluded under paragraph 5(2)(h.1).
