SUMMARY This enactment amends the Criminal Code to create the following criminal offences: (a) obtaining personal information from a third party by a false pretence or by fraud; (b) counselling a person to obtain personal information from a third party by a false pretence or by fraud; and (c) selling or otherwise disclosing personal information obtained from a third party by a false pretence or by fraud. It also amends the criminal offence of “personation with intent” to include fraudulent personation with intent to obtain any record containing personal information about a third party. As well, the enactment amends the Canada Evidence Act to prohibit the admission into evidence of any personal information obtained by fraud, false pretence or fraudulent personation. Finally, it amends the Competition Act to (a) characterize the business of fraudulently obtaining personal information as an illegal trade practice; (b) characterize the promotion of a product that is provided by means of fraud, false pretence or fraudulent personation as a false or misleading representation to the public; and (c) provide for the recovery of damages from corporations within Canada affiliated with corporations outside Canada that have obtained personal information from third parties in Canada by fraud, false pretence, or personation.		SOMMAIRE Le texte modifie le Code criminel afin d’ériger en infraction criminelle chacun des actes suivants : a) obtenir des renseignements personnels d’un tiers par fraude ou faux semblant; b) conseiller à une autre personne d’obtenir des renseignements personnels d’un tiers par fraude ou faux semblant; c) vendre ou communiquer de quelque autre façon des renseignements personnels obtenus d’un tiers par fraude ou faux semblant. En outre, il élargit l’infraction de supposition intentionnelle de personne afin d’y inclure le fait de se faire passer frauduleusement pour une autre personne dans le but d’obtenir des renseignements personnels sur un tiers. Le texte modifie également la Loi sur la preuve au Canada afin d’empêcher l’admission en preuve des pièces contenant des renseignements personnels obtenus par fraude, faux semblant ou usurpation d’identité. Enfin, il modifie la Loi sur la concurrence afin : a) de qualifier de pratique commerciale illégale l’activité consistant à obtenir frauduleusement des renseignements personnels; b) d’assimiler la promotion d’un produit fourni par fraude, faux semblant ou usurpation d’identité au fait de donner au public des indications fausses ou trompeuses; c) de prévoir le recouvrement de dommages-intérêts de personnes morales au Canada affiliées à des personnes morales d’un pays étranger qui ont obtenu des renseignements personnels de tiers au Canada par fraude, faux semblant ou usurpation d’identité.

2. (1) Subsection 362(1) of the Criminal Code is amended by striking out the word “or” at the end of paragraph (c) and by adding the following after paragraph (d):

2. (1) Le paragraphe 362(1) du Code criminel est modifié par adjonction, après l’alinéa d), de ce qui suit :

		(e) obtains identification information from any person by a false pretence or by fraud with intent to use the information to commit an offence under section 380 or 403; or
		(f) sells or otherwise discloses identification information obtained from any person by a false pretence or by fraud knowing that the information is intended to be used to commit an offence under section 380 or 403.

e) obtient de toute personne des renseignements identificateurs par un faux semblant ou par fraude dans l’intention de les utiliser en vue de commettre une infraction mentionnée aux articles 380 ou 403;
f) vend ou communique de quelque autre façon des renseignements identificateurs ainsi obtenus, sachant qu’ils sont destinés à servir à la commission d’une infraction mentionnée aux articles 380 ou 403.

(1.1) Section 362 of the Act is amended by adding the following after subsection (1):

Definition of “identification information”

(1.1) In subsection (1), “identification information” means information about any person, living or dead, that is capable of being used, whether alone or in conjunction with other information, to identify that person.

(1.1) Au paragraphe (1), « renseignements identificateurs » s’entend des renseignements concernant une personne, vivante ou morte, pouvant être utilisés, seuls ou avec d’autres renseignements, pour l’identifier.

(2) Section 362 of the Act is amended by adding the following after subsection (3):

Punishment		(3.1) Every one who commits an offence under paragraph (1)(e) or (f)
		(a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; or
		(b) is guilty of an offence punishable on summary conviction.

(3.1) Quiconque commet une infraction visée aux alinéas (1)e) ou f) est :		Peine
a) soit coupable d'un acte criminel et passible d'un emprisonnement maximal de deux ans;
b) soit coupable d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.
