An Act to amend the Quarantine Act

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 34 of the Quarantine Act is replaced by the following:

34. (1) This section applies to the operator of any of the following conveyances:

(a) a conveyance that is used in the business of carrying persons or cargo; and

(b) a prescribed conveyance.

34. (1) Le présent article s’applique aux conducteurs de l’un ou l’autre des véhicules suivants :

a) véhicule servant à l’exploitation d’une entreprise de transport de personnes ou de marchandises;

Operator to inform quarantine officer before arrival

(2) As soon as possible before a conveyance arrives at its destination in Canada, the operator shall inform a quarantine officer or cause a quarantine officer to be informed of any reasonable grounds to suspect that

(a) any person, cargo or other thing on board the conveyance could cause the spreading of a communicable disease listed in the schedule;

(b) a person on board the conveyance has died; or

(c) any prescribed circumstances exist.

(2) Dès que possible avant l’arrivée du véhicule à sa destination au Canada, le conducteur avise ou fait aviser l’agent de quarantaine de tout motif raisonnable qu’il a de soupçonner l’existence de l’un ou l’autre des faits suivants :

a) une personne, des marchandises ou toute autre chose à bord du véhicule risquent de propager une maladie transmissible inscrite à l’annexe;

b) une personne à bord du véhicule est décédée;

Operator to inform quarantine officer before departure

(3) As soon as possible before a conveyance departs from Canada through a departure point, the operator shall inform a quarantine officer or cause a quarantine officer to be informed of any circumstance referred to in paragraphs (2)(a) to (c) that exists.

(3) Dès que possible avant que le véhicule quitte le Canada par un point de sortie, le conducteur avise ou fait aviser l’agent de quarantaine de l’existence de tout fait visé aux alinéas (2)a) à c).

Exception

(4) No operator contravenes subsection (2) if it is not reasonably possible for the operator to inform a quarantine officer or cause a quarantine officer to be informed before the conveyance’s arrival at its destination in Canada, as long as the operator does so on the conveyance’s arrival at that destination.

(4) Le conducteur ne contrevient pas au paragraphe (2) s’il lui est raisonnablement impossible de donner ou de faire donner l’avis avant l’arrivée du véhicule à sa destination au Canada pourvu qu’il le fasse dès l’arrivée de celui-ci à cette destination.

2. Section 63 of the Act is replaced by the following:

Ministerial regulations

63. The Minister may make regulations amending the schedule by adding, deleting or amending the name of any communicable disease.

3. Section 71 of the Act is replaced by the following:

Contravention

71. Every person who contravenes subsection 6(2), 8(1) or 34(2) or (3), section 36 or 38, subsection 42(1), section 45 or 50, subsection 54(3), section 58 or 59 or subsection 73(2) or the regulations is guilty of an offence and liable on summary conviction to a fine of not more than $750,000 or to imprisonment for a term of not more than six months, or to both.

71. Quiconque contrevient aux paragraphes 6(2), 8(1) ou 34(2) ou (3), aux articles 36 ou 38, au paragraphe 42(1), aux articles 45 ou 50, au paragraphe 54(3), aux articles 58 ou 59, au paragraphe 73(2) ou aux règlements commet une infraction et encourt, sur déclaration de culpabilité par procédure sommaire, une amende maximale de 750 000 $ et un emprisonnement maximal de six mois, ou l’une de ces peines.

4. The schedule to the Act is amended by replacing the section references after the heading “SCHEDULE” with the following:

Coming into force

5. Despite section 84 of the Quarantine Act, section 34 of that Act, as enacted by section 1 of this Act, comes into force on the day on which this Act receives royal assent.

5. Malgré l’article 84 de la Loi sur la mise en quarantaine, l’article 34 de cette loi, édicté par l’article 1 de la présente loi, entre en vigueur à la date de sanction de la présente loi.
