CONSEQUENTIAL AMENDMENTS

77. Schedule I to the Access to Information Act is amended by striking out the following under the heading ``Other Government Institutions'':

78. Schedule I to the Act is amended by adding the following in alphabetical order under the heading ``Other Government Institutions'':

Merchant Navy Veteran and Civilian War-related Benefits Act

79. (1) The definition ``Commission'' in subsection 2(1) of the Merchant Navy Veteran and Civilian War-related Benefits Act is repealed.

(2) Subsection 2(1) of the Act is amended by adding the following in alphabetical order:

``Minister''

``Minister'' means the Minister of Veterans Affairs or such other member of the Queen's Privy Council for Canada as may be designated by the Governor in Council as the Minister for the purposes of this Act;

80. (1) The portion of section 8 of the Act before paragraph (a) is replaced by the following:

Evidence

8. For the purposes of this Part, where official records of a person's service, or of injuries or disease suffered or contracted by a person during service, are not available, the Minister may, in the absence of better evidence, accept a statutory declaration or like statement from a disinterested person if

(2) Paragraph 8(c) of the Act is replaced by the following:

    (c) after taking into consideration such corroboration as may be available, the Minister is satisfied, on the balance of probabilities, that the information in the declaration or statement is true.

81. Section 35 of the Act is replaced by the following:

Deduction

35. The Minister may deduct from any additional pension payable under this Part in respect of any dependant any amount payable by way of grant or allowance, whether payable out of public funds or otherwise, for the maintenance of the dependant.

82. Section 38 of the Act is replaced by the following:

Children

38. Where a person to whom a pension may be awarded under section 31 is under the age of seventeen years, no pension shall be paid to that person until that person attains the age of seventeen years, but the Minister may direct that, until that age is attained, the pension shall be administered for the benefit of that person by the Department of Veterans Affairs or a person or agency selected by the Minister.

83. Section 39 of the Act is replaced by the following:

Burial expenses

39. Where the death of an air raid precautions worker is attributable to war service injury or where at the time of death such worker was in receipt of a pension under this Part, and where the estate has not sufficient assets to pay the expenses of the burial, the Minister may, if the worker was not an in-patient under treatment in a hospital operated by the Department of Veterans Affairs, direct the payment of an amount not exceeding one hundred dollars in respect of those expenses.

84. The definition ``dangerous waters'' in subsection 56(1) of the Act is replaced by the following:

``dangerous waters'' means such oceans, seas or waters as the Veterans Review and Appeal Board established by the Veterans Review and Appeal Board Act may prescribe;

85. The Act is amended by replacing the word ``Commission'' with the word ``Minister'' in the following provisions:

    (a) section 4;

    (b) sections 10 to 12;

    (c) the definition ``enemy action or counteraction against the enemy'' in subsection 15.1(1);

    (d) section 15.3;

    (e) subsection 21(1);

    (f) subsection 21(3);

    (g) the definition ``air raid precautions worker'' in section 30;

    (h) section 40;

    (i) section 47;

    (j) section 53; and

    (k) section 55.

Defence Services Pension Continuation Act

86. Section 35 of the Defence Services Pension Continuation Act is replaced by the following:

Order to pay pension to another

35. Where the Minister is of the opinion that the pensioner is incapable of expending or is not expending the pension in a proper manner, the Minister may order that the pension be paid to such person as the Minister may appoint, in order that the money may be expended by that person, for the benefit of the pensioner and the members of the pensioner's family, and the expenses connected with such payment, if any, shall be paid by the Minister.

Halifax Relief Commission Pension Continuation Act

87. Section 3 of the Halifax Relief Commission Pension Continuation Act is amended by adding the following after subsection (2):

Vesting of powers in Minister of Veterans Affairs

(3) The powers, duties and functions of the Canadian Pension Commission under subsections (1) and (2) are, on and after the day on which this subsection comes into force, vested in and exercisable by the Minister of Veterans Affairs or such other member of the Queen's Privy Council for Canada as may be designated by the Governor in Council.

Income Tax Act

88. Paragraph 81(1)(f) of the Income Tax Act is replaced by the following:

Halifax disaster pensions, grants or allowances

    (f) a pension payment, a grant or an allowance in respect of death or injury sustained in the explosion in Halifax in 1917 and received from the Halifax Relief Commission the incorporation of which was confirmed by An Act respecting the Halifax Relief Commission, chapter 24 of the Statutes of Canada, 1918, or received pursuant to the Halifax Relief Commission Pension Continuation Act, chapter 88 of the Statutes of Canada, 1974-75-76;
