Meanwhile, the following executive summary is available.<br/><br/>On 4 February 2022, the Minister of Canadian Heritage introduced Bill C-11, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts (Online Streaming Act) and it was given first reading. <br/><br/>Bill C-11 amends the Broadcasting Act to, among other things,<br/>(a) add online undertakings — undertakings for the transmission or retransmission of programs over the Internet — as a distinct class of broadcasting undertakings;<br/>(b) specify that the Act does not apply in respect of programs uploaded to an online undertaking that provides a social media service by a user of the service, unless the programs are prescribed by regulation;<br/>(c) update the broadcasting policy for Canada set out in section 3 of the Act by, among other things, providing that the Canadian broadcasting system should<br/>(i) serve the needs and interests of all Canadians, including Canadians from racialized communities and Canadians of diverse ethnocultural backgrounds, socio-economic statuses, abilities and disabilities, sexual orientations, gender identities and expressions, and ages, and<br/>(ii) provide opportunities to Indigenous persons, programming that reflects Indigenous cultures and that is in Indigenous languages, and programming that is accessible without barriers to persons with disabilities;<br/>(d) enhance the vitality of English and French linguistic minority communities in Canada and foster the full recognition and use of both English and French in Canadian society, including by supporting the production and broadcasting of original programs in both languages;<br/>(e) specify that the Canadian Radio-television and Telecommunications Commission (the “Commission”) must regulate and supervise the Canadian broadcasting system in a manner that<br/>(i) takes into account the different characteristics of English, French and Indigenous language broadcasting and the different conditions under which broadcasting undertakings that provide English, French or Indigenous language programming operate,<br/>(ii) takes into account, among other things, the nature and diversity of the services provided by broadcasting undertakings,<br/>(iii) ensures that any broadcasting undertaking that cannot make maximum or predominant use of Canadian creative and other human resources in the creation, production and presentation of programming contributes to those Canadian resources in an equitable manner,<br/>(iv) facilitates the provision to Canadians of Canadian programs in both official languages, including those created and produced by English and French linguistic minority communities in Canada, as well as Canadian programs in Indigenous languages,<br/>(v) facilitates the provision of programs that are accessible without barriers to persons with disabilities, and<br/>(vi) takes into account the variety of broadcasting undertakings to which the Act applies and avoids imposing obligations on any class of broadcasting undertakings if that imposition will not contribute in a material manner to the implementation of the broadcasting policy;<br/>(f) amend the procedure relating to the issuance by the Governor in Council of policy directions to the Commission;<br/>(g) replace the Commission’s power to impose conditions on a licence with a power to make orders imposing conditions on the carrying on of broadcasting undertakings;<br/>(h) provide the Commission with the power to require that persons carrying on broadcasting undertakings make expenditures to support the Canadian broadcasting system;<br/>(i) authorize the Commission to provide information to the Minister responsible for that Act, the Chief Statistician of Canada and the Commissioner of Competition, and set out in that Act a process by which a person who submits certain types of information to the Commission may designate the information as confidential;<br/>(j) amend the procedure by which the Governor in Council may, under section 28 of that Act, set aside a decision of the Commission to issue, amend or renew a licence or refer such a decision back to the Commission for reconsideration and hearing;<br/>(k) specify that a person shall not carry on a broadcasting undertaking, other than an online undertaking, unless they do so in accordance with a licence or they are exempt from the requirement to hold a licence;<br/>(l) harmonize the punishments for offences under Part II of that Act and clarify that a due diligence defence applies to the existing offences set out in that Act; communautés racisées ou qui représentent la diversité de par leurs antécédents ethnoculturels, leur statut socio-économique, leurs capacités et handicaps, leur orientation sexuelle, leur identité ou expression de genre et leur âge,<br/>(ii) d’autre part, offrir des possibilités aux Autochtones, une programmation en langues autochtones qui reflète les cultures autochtones ainsi qu’une programmation accessible aux personnes handicapées et exempte d’obstacles;<br/>d) de favoriser l’épanouissement des minorités francophones et anglophones du Canada et de promouvoir la pleine reconnaissance et l’usage du français et de l’anglais dans la société canadienne, notamment en soutenant la production et la radiodiffusion d’émissions originales dans l’une ou l’autre langue;<br/>e) de préciser que le Conseil de la radiodiffusion et des télécommunications canadiennes (le «?Conseil?») réglemente et surveille le système canadien de radiodiffusion d’une manière qui, à la fois :<br/>(i) tient compte des caractéristiques de la radiodiffusion dans les langues française, anglaise et autochtones et des conditions différentes d’exploitation auxquelles sont soumises les entreprises de radiodiffusion qui diffusent la programmation dans l’une ou l’autre langue,<br/>(ii) tient compte, entre autres, de la nature et de la diversité des services fournis par les entreprises de radiodiffusion,<br/>(iii) assure que toute entreprise de radiodiffusion qui ne peut faire appel au maximum ou de manière prédominante aux ressources humaines — créatrices et autres — canadiennes pour la création, la production et la présentation de leur programmation contribue à ces ressources canadiennes d’une manière équitable,<br/>(iv) favorise la présentation aux Canadiens d’émissions canadiennes dans les deux langues officielles — notamment celles créées et produites par les minorités francophones et anglophones du Canada — de même qu’en langues autochtones,<br/>(v) favorise la présentation d’émissions accessibles aux personnes handicapées et exemptes d’obstacles,<br/>(vi) tient compte de la grande diversité d’entreprises assujetties à cette loi et évite d’imposer des obligations à l’égard de toute catégorie d’entreprises de radiodiffusion si une telle mesure ne contribue pas de façon importante à la mise en œuvre de la politique de radiodiffusion;<br/>f) de modifier la procédure par laquelle le gouverneur en conseil peut donner des instructions au Conseil au chapitre des grandes questions d’orientation;<br/>g) de remplacer le pouvoir du Conseil d’imposer des conditions attachées à une licence par celui de rendre des ordonnances imposant des conditions d’exploitation aux entreprises de radiodiffusion;<br/>h) d’octroyer au Conseil le pouvoir d’exiger certaines dépenses des exploitants d’entreprises de radiodiffusion afin de soutenir le système canadien de radiodiffusion;<br/>i) de permettre au Conseil de communiquer des renseignements au ministre chargé de l’application de cette loi, au statisticien en chef du Canada et au commissaire de la concurrence et de prévoir un processus par lequel certains renseignements peuvent être désignés comme confidentiels par la personne qui les fournit au Conseil;<br/>j) de modifier la procédure par laquelle le gouverneur en conseil peut, en vertu de l’article 28 de cette loi, annuler ou renvoyer au Conseil pour réexamen et nouvelle audience la décision de celui-ci d’attribuer, de modifier ou de renouveler une licence;<br/>k) de préciser qu’il est interdit d’exploiter une entreprise de
