Meanwhile, the following executive summary is available.<br/><br/>On 8 February 2013, the Minister of Justice introduced Bill C-54, An Act to amend the Criminal Code and the National Defence Act (mental disorder) (Not Criminally Responsible Reform Act), in the House of Commons and it was given first reading.<br/><br/>The Criminal Code mental disorder regime applies to a very small percentage of accused persons. Under Canadian criminal law, if an accused person cannot understand the nature of the trial, or its consequences, and cannot communicate with their lawyer on account of a mental disorder, the court will find that the person is “unfit to stand trial.” Once an accused becomes fit to stand trial, they will then be tried for the offence with which they were initially charged.<br/><br/>If a person is found to have committed the act that constitutes an offence, but lacked the capacity to appreciate what they did or know that it was wrong due to a mental disorder at the time, the court makes a special verdict of “Not Criminally Responsible on Account of Mental Disorder” (NCR). They are neither convicted, nor acquitted.<br/><br/>A person found either unfit to stand trial or NCR is referred to a provincial or territorial Review Board, who decides on a course of action. Under the current law, a Review Board can make one of three possible decisions:<br/><br/>• if the person does not pose a significant threat to public safety, an absolute discharge (only available for a person found NCR);<br/>• a conditional discharge; or,<br/>• detention in custody in a hospital.<br/><br/>Bill C-54 amends the mental disorder regime in the Criminal Code and the National Defence Act to specify that the paramount consideration in the decision-making process is the safety of the public and to create a scheme for finding that certain persons who have been found not criminally responsible on account of mental disorder are high-risk accused. En vertu du droit pénal canadien, si une personne accusée ne peut comprendre la nature de son procès, ou ses conséquences, et ne peut communiquer avec son avocat en raison de troubles mentaux, le tribunal déclarera la personne « inapte à subir un procès ». Lorsqu'elle deviendra apte à subir un procès, sa cause sera entendue relativement à l'infraction pour laquelle elle a initialement été accusée.<br/><br/>S'il est établi qu'une personne a commis un acte qui constitue une infraction, mais qu'elle n'avait pas la capacité d'en mesurer la gravité ou ne savait pas qu'il s'agissait d'un acte répréhensible en raison de troubles mentaux au moment des faits, le tribunal rend un verdict spécial de non-responsabilité criminelle en raison de troubles mentaux. La personne n'est ni condamnée, ni acquittée.<br/><br/>Une personne déclarée inapte à subir un procès ou NCR en raison de troubles mentaux doit se présenter devant une commission d'examen provinciale ou territoriale, qui détermine un plan d'action. En vertu de la loi actuelle, une commission d'examen peut prendre l'une de trois décisions possibles :<br/><br/>• l'absolution inconditionnelle, si la personne ne constitue pas une menace importante pour la sécurité publique (seulement pour une personne déclarée NCR);<br/>• l'absolution conditionnelle;<br/>• la détention sous garde dans un hôpital.<br/><br/>Le projet de loi C-54 modifie le cadre législatif applicable aux troubles mentaux dans le Code criminel et la Loi sur la défense nationale afin de préciser que la sécurité du public est le facteur prépondérant dans le processus décisionnel. Il crée un mécanisme afin de prévoir que certaines personnes qui reçoivent un verdict de non-responsabilité criminelle pour cause de troubles mentaux peuvent être déclarées des accusés à haut risque et il accroît la participation des victimes.
