On 30 September 2010, the Minister of Finance introduced Bill C-47, A second Act to implement certain provisions of the budget tabled in Parliament on March 4, 2010 and other measures (Sustaining Canada's Economic Recovery Act), in the House of Commons and it was given first reading.

Part 1 implements a number of income tax measures proposed in the March 4, 2010 Budget. Among other things it:

•\tallows for the sharing of the Canada Child Tax Benefit, the Universal Child Care Benefit and the Goods and Services Tax/Harmonized Sales Tax credit for eligible shared custody parents;
•\tallows Registered Retirement Savings Plan proceeds to be transferred to a Registered Disability Savings Plan on a tax-deferred basis;
•\timplements disbursement quota reform for registered charities;
•\tbetter targets the tax incentives in place for employee stock options;
•\texpands the availability of accelerated capital cost allowance for clean energy generation;
•\tadjusts the capital cost allowance rate for television set-top boxes to better reflect the useful life of these assets;
•\tclarifies the definition of a principal-business corporation for the purposes of the rules relating to Canadian Renewable and Conservation Expenses;
•\tintroduces amendments that are consequential to the introduction in 2011 of new International Financial Reporting Standards by the Accounting Standards Board; and
•\tamends the Canada Pension Plan, the Employment Insurance Act and the Income Tax Act to provide legislative authority for the Canada Revenue Agency to issue online notices if the taxpayer so requests.

Part 1 also implements income tax measures that were previously announced including:
•\trules to facilitate the implementation of Employee Life and Health Trusts
•\tindexing of the working income tax benefit;
•\ttechnical changes concerning TFSAs; and
•\tan amendment to the rules regarding labour sponsored venture capital corporations that are consequential to the introduction of TFSAs.

Part 2 amends the Air Travellers Security Charge Act, the Excise Act, 2001, the Excise Tax Act and the New Harmonized Value-added Tax System Regulations to provide legislative authority for the Canada Revenue Agency to issue online notices if the taxpayer so requests. It also amends the Air Travellers Security Charge Act, the Excise Act, the Excise Act, 2001, the Excise Tax Act, the Brewery Departmental Regulations and the Brewery Regulations to allow certain small remitters to file and remit semi-annually rather than monthly. Part 2 also amends the Air Travellers Security Charge Act and the Excise Tax Act to extend the protection from civil liability claims that is already provided under the Income Tax Act and other federal statutes to agents of the Crown who collect the Goods and Services Tax/Harmonized Sales Tax and the air travellers security charge in intended compliance with their statutory obligations.

Part 3 amends the Federal-Provincial Fiscal Arrangements Act to facilitate the sharing of taxes under Part I.01 and Part X.5 of the Income Tax Act with provinces and territories.

Part 4 amends the Bank Act and the Financial Consumer Agency of Canada Act to require that banks belong to an approved external complaints body and to authorize the Governor in Council to prescribe the approval requirement for that body. The amendments also assign the responsibility for managing the approval process and supervising the approved external complaints bodies to the Financial Consumer Agency of Canada.

Part 5 amends the Canada Disability Savings Act to allow a 10-year carry forward of Canada Disability Savings Grant and Canada Disability Savings Bond entitlements.

Part 6 amends section 11.1 of the Customs Act to exempt from the User Fees Act fees that are charged for expedited border clearance programs and that are coordinated with international partners.

Part 7 amends the Federal-Provincial Fiscal Arrangements Act to implement the total transfer protection for 2010-11, to set out the treatment of the one-time transfer protection payment under the fiscal stabilization program, update legislative references made in the fiscal stabilization provisions and give greater clarity to the calculation of the fiscal stabilization payment.

Part 8 amends the Office of the Superintendent of Financial Institutions Act. Among other things it
•\tharmonizes the assessment of costs associated with the administration of the Pension Benefits Standards Act, 1985 with the regime in place for the assessment of costs associated with the administration of laws governing financial institutions; and
•\tallows the Superintendent to remit assessments, interim assessments and penalties and to write off certain debts.

Part 9 amends the Pension Benefits Standards Act, 1985. Among other things it
•\tauthorizes the Minister of Finance to enter into an agreement with the provinces respecting pension plans that are subject to the pension legislation of more than one jurisdiction;
•\tauthorizes the Minister of Finance to designate an entity for the purposes of receiving, holding and disbursing the pension benefit credit of any person who cannot be located;
•\tpermits information to be provided in electronic form, including information provided by the administrator of a pension plan to members or to the Superintendent;
•\tallows the administrator of a pension plan to offer investment options with respect to accounts maintained in respect of a defined contribution provision or accounts maintained for additional voluntary contributions;
•\tprovides rules regarding negotiated contribution plans;
•\trequires consent of a member’s spouse or common-law partner before the transfer of the member’s pension benefit credit to a retirement savings plan; and
•\tauthorizes the Superintendent to direct the administrator of a pension plan that is subject to the pension legislation of more than one jurisdiction to establish a separate pension plan for certain members, former members and survivors.

•\td’ajuster le taux de la déduction pour amortissement applicable aux boîtes décodeurs pour téléviseur afin qu’il tienne mieux compte de leur durée de vie utile;
•\tde préciser la définition de « société exploitant une entreprise principale » pour l’application des règles relatives aux frais liés aux énergies renouvelables et à l’économie d’énergie au Canada;
•\td’apporter des modifications corrélatives découlant de l’adoption en 2011 de nouvelles normes internationales d’information financière (IFRS) par le Conseil des normes comptables;
•\tde modifier le Régime de pensions du Canada, la Loi sur l’assurance-emploi et la Loi de l’impôt sur le revenu de façon à conférer à l’Agence du revenu du Canada l’autorisation législative d’émettre des avis en ligne à la demande du contribuable.

Elle met aussi en oeuvre des mesures concernant l’impôt sur le revenu qui ont déjà été annoncées, incluant :
•\tles règles visant à faciliter l’établissement de fiducies de soins de santé au bénéfice d’employés;
•\tl’indexation de la Prestation fiscale pour le revenu de travail;
•\tles changements techniques concernant le CÉLI;
•\tdes modifications aux règles concernant les sociétés à capital de risque de travailleurs, découlant de la mise en place du CÉLI.

La partie 2 modifie la Loi sur le droit pour la sécurité des passagers du transport aérien, la Loi de 2001 sur l’accise, la Loi sur la taxe d’accise et le Règlement sur le nouveau régime de la taxe à valeur ajoutée harmonisée de façon à conférer à l’Agence du revenu du Canada l’autorisation législative d’émettre des avis en ligne à la demande du contribuable. En outre, elle modifie la Loi sur le droit pour la sécurité des passagers du transport aérien, la Loi sur l’accise, la Loi de 2001 sur l’accise, la Loi sur la taxe d’accise, le Règlement ministériel sur les brasseries et le Règlement sur les brasseries afin de permettre à certains petits remettants de produire leurs déclarations et de faire leurs versements à intervalles semestriels plutôt que mensuels. Par ailleurs, elle modifie la Loi sur le droit pour la sécurité des passagers du transport aérien et la Loi sur la taxe d’accise afin d’accorder aux mandataires de l’État qui perçoivent le droit pour la sécurité des passagers du transport aérien ou la taxe sur les produits et services et la taxe de vente harmonisée en conformité intentionnelle avec leurs obligations législatives la même protection contre les poursuites au civil que celle prévue par la Loi de l’impôt sur le revenu et d’autres lois fédérales.

La partie 3 modifie la Loi sur les arrangements fiscaux entre le gouvernement fédéral et les provinces afin de faciliter le partage des impôts prévus par les parties I.01 et X.5 de la Loi de l’impôt sur le revenu avec les provinces et les territoires.

La partie 4 modifie la Loi sur les banques et la Loi sur l’Agence de la consommation en matière financière du Canada afin d’exiger des banques qu’elles soient membres d’un organisme externe de traitement des plaintes approuvé et afin d’autoriser le gouverneur en conseil à prévoir les exigences à respecter pour obtenir l’approbation. Les modifications confient également à l’Agence de la consommation en matière financière du Canada la responsabilité de gérer le processus d’approbation et de superviser les organismes externes de traitement des plaintes approuvés.

La partie 5 modifie la Loi canadienne sur l’épargne-invalidité afin de permettre le report prospectif sur dix ans des droits à la subvention canadienne pour l’épargne-invalidité et au bon canadien pour l’épargne-invalidité.

Le partie 6 modifie l’article 11.1 de la Loi sur les douanes pour soustraire à l’application de la Loi sur les frais d’utilisation les frais imposés dans le cadre des programmes de passage accéléré à la frontière et fixés en collaboration avec des partenaires internationaux.

La partie 7 modifie la Loi sur les arrangements fiscaux entre le gouvernement fédéral et les provinces en vue de la mise en oeuvre de la protection des transferts totaux pour 2010-2011 et pour préciser la manière dont seront traités les paiements ponctuels de protection des transferts dans le cadre du programme de stabilisation. Les modifications mettent également à jour des renvois figurant dans les dispositions relatives à la stabilisation et clarifient la méthode de calcul des paiements de stabilisation.

La partie 8 modifie la Loi sur le Bureau du surintendant des institutions financières. Entre outre il
•\tharmonise le recouvrement des coûts d’administration de la Loi de 1985 sur les normes de prestation de pension avec le régime qui s’applique au recouvrement des coûts d’administration des lois régissant les institutions financières;
•\tpermet au surintendant d’accorder des remises de cotisations et de pénalités et de radier certaines créances.

La partie 9 modifie la Loi de 1985 sur les normes de prestation de pension. Entre outre il
•\tpermet au ministre des Finances de conclure un accord avec les provinces concernant les régimes de pension assujettis à la législation sur les pensions de plus d’une autorité législative;
•\tpermet au ministre des Finances de désigner une entité chargée de recevoir, de détenir et de payer les droits à pension de bénéficiaires introuvables;
•\tpermet l’utilisation de moyens électroniques pour fournir de l’information, notamment l’information que l’administrateur d’un régime de pension fournit aux participants et au surintendant;
•\tpermet à l’administrateur d’un régime de pension d’offrir des choix en matière de placement à l’égard des comptes qui ont trait à une disposition à cotisations déterminées ou aux cotisations facultatives;
•\tprévoit des règles propres aux régimes à cotisations négociées;
•\texige le consentement de l’époux ou du conjoint de fait du participant avant le transfert de droits à pension de ce dernier à un régime d’épargne-retraite;
•\tpermet au surintendant d’ordonner à l’administrateur d’un régime de pension qui est assujetti à la législation sur les pensions de plus d’une autorité législative d’instituer un régime de pension distinct pour certains participants, anciens participants et survivants.
