SOMMAIRE
Le texte modifie l’article 163.1 du Code criminel afin de déclarer que les alinéas 163.1(4)a) et 163.1(4.1)a), lesquels prévoient des peines minimales obligatoires à l’égard des infractions de possession de matériel d’abus et d’exploitation pédosexuels et d’accès au matériel d’abus et d’exploitation pédosexuels respectivement, ont effet indépendamment de l’article 12 de la Charte canadienne des droits et libertés.
SUMMARY
This enactment amends section 163.1 of the Criminal Code to declare that paragraphs 163.1(4)(a) and 163.1(4.1)(a) — which include mandatory minimum sentences for the offences of possession of child sexual abuse and exploitation material and accessing child sexual abuse and exploitation material, respectively — operate notwithstanding section 12 of the Canadian Charter of Rights and Freedoms.

1 L’article 163.1 du Code criminel est modifié par adjonction, après le paragraphe (4.1), de ce qui suit :

(4.11) Pursuant to subsection 33(1) of the Canadian Charter of Rights and Freedoms, paragraphs 163.1(4)(a) and 163.1(4.1)(a) of this Act are declared to operate notwithstanding section 12 of the Canadian Charter of Rights and Freedoms.
