Meanwhile, the following executive summary is available.<br/><br/>On 3 June 2025, the Minister of Public Safety introduced Bill C-2, An Act respecting certain measures relating to the security of the border between Canada and the United States and respecting other related security measures (Strong Borders Act) and it was given first reading.   <br/><br/>Part 1 amends the Customs Act to provide the Canada Border Services Agency with facilities free of charge for carrying out any purpose related to the administration or enforcement of that Act and other Acts of Parliament and to provide officers of that Agency with access at certain locations to goods destined for export. It also includes transitional provisions.<br/>Part 2 amends the Controlled Drugs and Substances Act to create a new temporary accelerated scheduling pathway that allows the Minister of Health to add precursor chemicals to Schedule V to that Act. It also makes related amendments to the Controlled Drugs and Substances Act (Police Enforcement) Regulations and the Precursor Control Regulations.<br/>Part 3 amends the Controlled Drugs and Substances Act and the Cannabis Act to confirm that the Governor in Council may, on the recommendation of the Minister of Public Safety and Emergency Preparedness, make regulations exempting members of law enforcement from the application of any provision of the Criminal Code that creates drug-related inchoate offences when they are undertaking lawful investigations.<br/>Part 4 amends the Canada Post Corporation Act to permit the demand, seizure, detention or retention of anything in the course of post only in accordance with an Act of Parliament. It also amends that Act to expand the Canada Post Corporation’s authority to open mail in certain circumstances to include the authority to open letters.<br/>Part 5 amends the Oceans Act to provide that coast guard services include activities related to security and to authorize the responsible minister to collect, analyze and disclose information and intelligence.<br/>Part 6 amends the Department of Citizenship and Immigration Act to authorize the Minister of Citizenship and Immigration to disclose, for certain purposes and subject to any regulations, personal information under the control of the Department within the Department and to certain other federal and provincial government entities.<br/>It also amends the Immigration and Refugee Protection Act to authorize the making of regulations relating to the disclosure of information collected for the purposes of that Act to federal departments and agencies.<br/>Part 7 amends the Immigration and Refugee Protection Act to, among other things,<br/>(a) eliminate the designated countries of origin regime;<br/>(b) authorize the Minister of Citizenship and Immigration to specify the information and documents that are required in support of a claim for refugee protection;<br/>(c) authorize the Refugee Protection Division of the Immigration and Refugee Board to determine that claims for refugee protection that have not yet been referred to the Refugee Protection Division have been abandoned in certain circumstances;<br/>(d) provide the Minister of Citizenship and Immigration with the power to determine that claims for refugee protection that have not yet been referred to the Refugee Protection Division have been withdrawn in certain circumstances;<br/>(e) require the Refugee Protection Division and the Refugee Appeal Division to suspend certain proceedings respecting a claim for refugee protection if the claimant is not present in Canada;<br/>(f) clarify that decisions of the Immigration and Refugee Board must be rendered, and reasons for those decisions must be given, in the manner specified by its Chairperson; and<br/>(g) authorize regulations to be made setting out the circumstances in which the Minister of Citizenship and Immigration or the Minister of Public Safety and Emergency Preparedness must designate, in relation to certain proceedings or applications, a representative for persons who are under 18 years of age or who are unable to appreciate the nature of the proceeding or application.<br/>It also includes transitional provisions.<br/>Part 8 amends the Immigration and Refugee Protection Act to, among other things,<br/>(a) authorize the Governor in Council to make an order specifying that certain applications made under that Act are not to be accepted for processing, or that the processing of those applications is to be suspended or terminated, when the Governor in Council is of the opinion that it is in the public interest to do so;<br/>(b) authorize the Governor in Council to make an order to cancel, suspend or vary certain documents issued under that Act, or to impose or vary conditions, when the Governor in Council is of the opinion that it is in the public interest to do so;<br/>(c) for the application of an order referred to in paragraph (b), require a person to appear for an examination, answer questions truthfully and produce all relevant documents or evidence that an officer requires; and<br/>(d) authorize the Governor in Council to make regulations prescribing circumstances in which a document issued under that Act can be cancelled, suspended or varied, and in which officers may terminate the processing of certain applications made under that Act.<br/>Part 9 amends the Immigration and Refugee Protection Act to add two new grounds of ineligibility for claims for refugee protection as well as powers to make regulations respecting exceptions to those new grounds. It also includes a transitional provision respecting the retroactive application of those new grounds.<br/>Part 10 amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to, among other things,<br/>(a) increase the maximum administrative monetary penalties that may be imposed for certain violations and the maximum punishments that may be imposed for certain criminal offences under that Act;<br/>(b) replace the existing optional compliance agreement regime with a new mandatory compliance agreement regime that, among other things,<br/>(i) requires every person or entity that receives an administrative monetary penalty for a prescribed violation to enter into a compliance agreement with the Financial Transactions and Reports Analysis Centre of Canada (the Centre),<br/>(ii) requires the Director of the Centre to make a compliance order if the person or entity refuses to enter into a compliance agreement or fails to comply with such an agreement, and<br/>(iii) designates the contravention of a compliance order as a new violation under that Act;<br/>(c) require persons or entities referred to in section 5 of that Act, other than those already required to register, to enroll with the Centre; and<br/>(d) authorize the Centre to disclose certain information to the Commissioner of Canada Elections, subject to certain conditions.<br/>It also makes consequential and related amendments to other Acts and the Proceeds of Crime (Money Laundering) and Terrorist Financing Administrative Monetary Penalties Regulations and includes transitional provisions.<br/>Part 11 amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to prohibit certain entities from accepting cash deposits from third parties and certain persons or entities from accepting cash payments, donations or deposits of $10,000 or more. It also makes a related amendment to the Proceeds of Crime (Money Laundering) and Terrorist Financing Administrative Monetary Penalties Regulations.<br/>Part 12 amends the Office of the Superintendent of Financial Institutions Act to make the Director of the Financial Transactions and Reports Analysis Centre of Canada a member of the committee established under subsection 18(1) of that Act. It also amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to enable the Director to exchange information with the other members of that committee.<br/>Part 13 amends the Sex Offender Information Registration Act to, among other things,<br/>(a) make certain changes to a sex offender’s reporting obligations, including the circumstances in which they are required to report, the information that must be provided and the time within which it is to be provided;<br/>(b) provide that any of a sex offender’s physical characteristics that may assist in their identification may be recorded when they report to a registration centre;<br/>(c) clarify what may constitute a reasonable excuse for a sex offender’s non-compliance with the requirement to give at least 14 days’ notice prior to a departure from their residence for seven or more consecutive days;<br/>(d) authorize the Canada Border Services Agency to disclose certain information relating to a sex offender’s arrival in and departure from Canada to law enforcement agencies for the purposes of the administration and enforcement of that Act;<br/>(e) authorize, in certain circumstances, the disclosure of information collected under that Act if there are reasonable grounds to believe that it will assist in the prevention or investigation of a crime of a sexual nature; and<br/>(f) clarify that a person who discloses information under section 16 of that Act with the belief that they are acting in accordance with that section is not guilty of an offence under section 17 of that Act.<br/>It also makes a related amendment to the Customs Act.<br/>Part 14 amends various Acts to modernize certain provisions respecting the timely gathering and production of data and information during an investigation. It, among other things,<br/>(a) amends the Criminal Code to, among other things,<br/>(i) facilitate access to basic information that will assist in the investigation of federal offences through an information demand or a judicial production order to persons who provide services to the public,<br/>(ii) clarify the response time for production orders and the ability of peace officers and public officers to receive and act on certain information that is voluntarily provided to them and on certain information that is publicly available,<br/>(iii) specify certain circumstances in which peace officers and public officers may obtain evidence, including subscriber information, in exigent circumstances,<br/>(iv) allow a justice or judge to authorize, in a warrant, a peace officer or public officer to obtain tracking data or transmission data that relates to any thing that is similar to a thing in relation to which data is authorized to be obtained under the warrant and that is unknown at the time the warrant is issued,<br/>(v) provide and clarify authorities by which computer data may be examined, and<br/>(vi) allow a justice or judge to authorize a peace officer or public officer to make a request to a foreign entity that provides telecommunications services to the public to produce transmission data or subscriber information that is in its possession or control;<br/>(b) makes a consequential amendment to the Foreign Publishers Advertising Services Act;<br/>(c) amends the Mutual Legal Assistance in Criminal Matters Act to allow the Minister of Justice to authorize a competent authority to make arrangements for the enforcement of a decision made by an authority of a state or entity that is empowered to compel the production of transmission data or subscriber information that is in the possession or control of a person in Canada;<br/>(d) amends the Canadian Security Intelligence Service Act to, among other things,<br/>(i) facilitate access to basic information that will assist the Canadian Security Intelligence Service in the performance of its duties and functions under section 12 or 16 of that Act through information demands given to persons or entities that provide services to the public and judicial information orders against such persons and entities, and<br/>(ii) clarify the response time for production orders; and<br/>(e) amends the Controlled Drugs and Substances Act and the Cannabis Act to provide and clarify authorities by which computer data may be examined.<br/>Part 15 enacts the Supporting Authorized Access to Information Act. That Act establishes a framework for ensuring that electronic service providers can facilitate the exercise, by authorized persons, of authorities to access information conferred under the Criminal Code or the Canadian Security Intelligence Service Act.<br/>Part 16 amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to permit a person or entity referred to in section 5 of that Act to collect and use an individual’s personal information without that individual’s knowledge or consent if<br/>(a) the information is disclosed to the person or entity by a government department, institution or agency or law enforcement agency; and<br/>(b) the collection and use are for the purposes of detecting or deterring money laundering, terrorist activity financing or sanctions evasion or for a consistent purpose.<br/>It also makes related amendments to the Personal Information Protection and Electronic Documents Act.</div>","ShortLegislativeSummaryFr":"<div>Les Service d’information, d’éducation et de recherche parlementaires de la Bibliothèque du Parlement rédige actuellement le résumé législatif de ce projet de loi. Elle apporte aussi des modifications connexes au Règlement sur l’exécution policière de la Loi réglementant certaines drogues et autres substances et au Règlement sur les précurseurs.<br/><br/>La partie 3 modifie la Loi réglementant certaines drogues et autres substances et la Loi sur le cannabis afin de confirmer que le gouverneur en conseil peut prendre, sur la recommandation du ministre de la Sécurité publique et de la Protection civile, des règlements soustrayant les membres des forces de l’ordre, dans le cadre des enquêtes licites qu’ils mènent, à l’application des dispositions du Code criminel qui prévoient des infractions inchoatives liées à la drogue.<br/><br/>La partie 4 modifie la Loi sur la Société canadienne des postes pour ne permettre la revendication, la saisie ou la rétention de toute chose en cours de transmission postale qu’en conformité avec une loi fédérale. De plus, elle étend à l’ouverture de lettres le pouvoir de la Société canadienne des postes d’ouvrir des envois dans certaines circonstances.<br/><br/>La partie 5 modifie la Loi sur les océans afin d’ajouter des activités liées à la sécurité aux services de la garde côtière et d’autoriser le ministre responsable à recueillir, à analyser et à communiquer de l’information et du renseignement.<br/><br/>La partie 6 modifie la Loi sur le ministère de la Citoyenneté et de l’Immigration pour permettre au ministre de la Citoyenneté et de l’Immigration de communiquer, à certaines fins et sous réserve de tout règlement, des renseignements personnels qui relèvent de ce ministère en son sein et à certaines autres entités publiques fédérales ou provinciales.<br/><br/>Elle modifie également la Loi sur l’immigration et la protection des réfugiés pour permettre la prise de règlements concernant la communication à des ministères et organismes fédéraux de renseignements recueillis pour l’application de cette loi.<br/><br/>La partie 7 modifie la Loi sur l’immigration et la protection des réfugiés pour, notamment :<br/><br/>a) abolir le régime de désignation de pays d’origine;<br/><br/>b) permettre au ministre de la Citoyenneté et de l’Immigration de préciser les renseignements et les documents exigés au soutien d’une demande d’asile;<br/><br/>c) autoriser la Section de la protection des réfugiés de la Commission de l’immigration et du statut de réfugié à prononcer le désistement des demandes d’asile dans certains cas avant qu’elles ne lui soient déférées;<br/><br/>d) conférer au ministre de la Citoyenneté et de l’Immigration le pouvoir de prononcer le retrait des demandes d’asile dans certains cas avant qu’elles ne soient déférées à la Section de la protection des réfugiés;<br/><br/>e) contraindre la Section de la protection des réfugiés et la Section d’appel des réfugiés à surseoir à l’étude de l’affaire si le demandeur n’est pas présent au Canada;<br/><br/>f) préciser que les décisions de la Commission de l’immigration et du statut de réfugié et les motifs sont rendus de la manière précisée par son président;<br/><br/>g) permettre la prise de règlements prévoyant les cas où le ministre de la Citoyenneté et de l’Immigration ou le ministre de la Sécurité publique et de la Protection civile doivent désigner, dans le cadre de certaines procédures ou demandes, un représentant à l’intéressé qui n’a pas atteint l’âge de dix-huit ans ou qui n’est pas en mesure de comprendre la nature de la procédure ou de la demande.<br/><br/>Elle prévoit aussi des dispositions transitoires.<br/><br/>La partie 8 modifie la Loi sur l’immigration et la protection des réfugiés afin, notamment :<br/><br/>a) d’autoriser le gouverneur en conseil, s’il estime que l’intérêt public le justifie, à prendre un décret pour prévoir que ne seront pas examinées certaines demandes présentées au titre de cette loi ou pour suspendre l’examen de ces demandes ou y mettre fin définitivement;<br/><br/>b) d’autoriser le gouverneur en conseil, s’il estime que l’intérêt public le justifie, à prendre un décret visant à annuler, à suspendre ou à modifier certains documents délivrés au titre de cette loi ou visant à imposer ou à modifier des conditions;<br/><br/>c) de prévoir que, pour la mise en œuvre d’un décret visé à l’alinéa b), toute personne doit se soumettre au contrôle à la demande de l’agent, répondre véridiquement aux questions posées et produire tous les documents et éléments de preuve pertinents requis;<br/><br/>d) d’autoriser le gouverneur en conseil à prendre des règlements prévoyant les cas dans lesquels un document délivré au titre de cette loi peut être annulé, suspendu ou modifié et dans lesquels un agent peut mettre fin définitivement à l’examen de certaines demandes présentées au titre de cette loi.<br/><br/>La partie 9 modifie la Loi sur l’immigration et la protection des réfugiés afin d’ajouter deux nouveaux motifs d’irrecevabilité pour les demandes d’asile ainsi que les pouvoirs de prendre des règlements relatifs aux exceptions applicables à ces nouveaux motifs. Elle prévoit également une disposition transitoire relative à l’application rétroactive de ces nouveaux motifs.<br/><br/>La partie 10 modifie la Loi sur le recyclage des produits de la criminalité et le financement des activités terroristes afin, notamment :<br/><br/>a) d’augmenter le montant maximal des sanctions administratives pécuniaires pouvant être imposées pour certaines violations et les peines maximales pouvant être imposées pour certaines infractions criminelles prévues par cette loi;<br/><br/>b) de remplacer le régime de transactions facultatif existant par un nouveau régime de transactions obligatoire qui, notamment :<br/><br/>(i) exige que toute personne ou entité qui reçoit une sanction administrative pécuniaire pour une violation réglementaire conclue une transaction avec le Centre d’analyse des opérations et déclarations financières du Canada (Centre),<br/><br/>(ii) exige que le directeur du Centre donne un ordre de conformité à toute personne ou entité qui refuse de conclure la transaction ou qui ne se conforme pas à celle-ci,<br/><br/>(iii) prévoit que la contravention à un ordre de conformité est une nouvelle violation prévue par cette loi;<br/><br/>c) d’exiger que les personnes ou entités visées à l’article 5 de la loi, autres que celles qui sont déjà tenues de s’inscrire sous le régime de l’article 11.1, s’inscrivent, sous le régime de l’article 11.4001, auprès du Centre;<br/><br/>d) d’autoriser le Centre à communiquer certains renseignements au commissaire aux élections fédérales, sous réserve de certaines conditions.<br/><br/>Par ailleurs, elle apporte des modifications corrélatives et connexes à d’autres lois et au Règlement sur les pénalités administratives — recyclage des produits de la criminalité et financement des activités terroristes et prévoit des dispositions transitoires.<br/><br/>La partie 11 modifie la Loi sur le recyclage des produits de la criminalité et le financement des activités terroristes afin d’interdire à certaines entités d’accepter les dépôts en espèces de la part d’un tiers et à certaines personnes ou entités d’accepter les paiements, dons ou dépôts en espèces de 10 000 $ ou plus. Elle apporte aussi une modification connexe au Règlement sur les pénalités administratives — recyclage des produits de la criminalité et financement des activités terroristes.<br/><br/>La partie 12 modifie la Loi sur le Bureau du surintendant des institutions financières afin d’ajouter le directeur du Centre d’analyse des opérations et déclarations financières du Canada à la composition du comité constitué en vertu du paragraphe 18(1) de cette loi. Elle modifie également la Loi sur le recyclage des produits de la criminalité et le financement des activités terroristes afin de permettre au directeur d’échanger des renseignements avec les autres membres du comité.<br/><br/>La partie 13 modifie la Loi sur l’enregistrement de renseignements sur les délinquants sexuels afin, notamment :<br/><br/>a) d’apporter certaines modifications aux obligations des délinquants sexuels en matière de comparution, notamment les circonstances dans lesquelles celle-ci est exigée, les renseignements qui doivent être fournis et les délais associés à leur fourniture;<br/><br/>b) de prévoir que toute caractéristique physique du délinquant sexuel pouvant permettre de l’identifier puisse être consignée lorsqu’il comparait à un bureau d’inscription;<br/><br/>c) de préciser ce qui peut constituer une excuse raisonnable pour le non-respect par le délinquant sexuel de l’obligation de donner avis au moins quatorze jours avant son départ de sa résidence pendant au moins sept jours consécutifs;<br/><br/>d) d’autoriser l’Agence des services frontaliers du Canada à communiquer aux organismes d’application de la loi certains renseignements concernant l’arrivée au Canada et le départ du Canada des délinquants sexuels, aux fins d’exécution et de contrôle d’application de cette loi;<br/><br/>e) d’autoriser, dans certaines circonstances, la communication des renseignements recueillis en vertu de cette loi, s’il existe des motifs raisonnables de croire qu’elle est utile pour prévenir des crimes de nature sexuelle ou pour enquêter sur ceux-ci;<br/><br/>f) de préciser que la personne qui communique des renseignements en vertu de l’article 16 de cette loi et qui croit agir conformément à cet article n’est pas coupable d’une infraction prévue à l’article 17 de cette loi.<br/><br/>Elle apporte également une modification connexe à la Loi sur les douanes.<br/><br/>La partie 14 modifie diverses lois afin de moderniser certaines dispositions relatives à la collecte et à la communication de données et de renseignements en temps opportun lors d’une enquête. Notamment, elle :<br/><br/>a) modifie le Code criminel pour, notamment :<br/><br/>(i) faciliter l’accès aux renseignements de base qui seront utiles à l’enquête relative à des infractions fédérales au moyen d’un ordre de fournir des renseignements ou d’une ordonnance de communication à des personnes fournissant des services au public,<br/><br/>(ii) préciser le temps de réponse aux ordonnances de communication et la possibilité pour l’agent de la paix et le fonctionnaire public de recevoir et de donner suite à certains renseignements qui leur sont fournis volontairement ou qui sont accessibles au public,<br/><br/>(iii) préciser dans quelles circonstances les agents de la paix et les fonctionnaires publics peuvent recueillir des éléments de preuve en cas d’urgence, notamment des renseignements relatifs à l’abonné,<br/><br/>(iv) permettre à un juge de paix ou à un juge d’autoriser, dans le mandat, un agent de la paix ou un fonctionnaire public à obtenir des données de localisation ou des données de transmission qui concernent des choses similaires à celle en lien avec laquelle des données sont autorisées à être obtenues en vertu du mandat et qui sont inconnues au moment où le mandat est délivré,<br/><br/>(v) conférer et clarifier des pouvoirs d’examen de données informatiques,<br/><br/>(vi) permettre à un juge de paix ou à un juge d’autoriser un agent de la paix ou un fonctionnaire public à demander à une entité étrangère qui fournit des services de télécommunication au public de communiquer les données de transmission ou les renseignements relatifs à l’abonné qui sont en sa possession ou à sa disposition;<br/><br/>b) apporte une modification corrélative à la Loi sur les services publicitaires fournis par des éditeurs étrangers;<br/><br/>c) modifie la Loi sur l’entraide juridique en matière criminelle afin de permettre au ministre de la Justice d’autoriser une autorité compétente à prendre des mesures d’exécution d’une décision rendue par une autorité d’un État ou d’une entité habilitée à ordonner la communication de données de transmission ou de renseignements relatifs à l’abonné qui sont en la possession ou à la disposition d’une personne au Canada;<br/><br/>d) modifie la Loi sur le Service canadien du renseignement de sécurité pour, notamment :<br/><br/>(i) faciliter l’accès à des renseignements de base qui aideront le Service canadien du renseignement de sécurité dans l’exercice des fonctions qui lui sont conférées par les articles 12 ou 16 de cette loi au moyen d’un ordre de fournir des informations donné à des personnes ou à des entités fournissant des services au public ou d’une ordonnance de fourniture d’informations à de telles personnes ou entités,<br/><br/>(ii) préciser le temps de réponse aux ordonnances de communication;<br/><br/>e) modifie la Loi réglementant certaines drogues et autres substances et la Loi sur le cannabis pour conférer et clarifier des pouvoirs d’examen de données informatiques.<br/><br/>La partie 15 édicte la Loi sur le soutien en matière d’accès autorisé à de l’information. Cette loi établit un cadre qui a pour but de faire en sorte que les fournisseurs de services électroniques puissent faciliter l’exercice efficace, par des personnes autorisées, de pouvoirs en matière d’accès à de l’information qui sont conférés à ces personnes sous le régime du Code criminel ou de la Loi sur le Service canadien du renseignement de sécurité.<br/><br/>La partie 16 modifie la Loi sur le recyclage des produits de la criminalité et le financement des activités terroristes dans le but de permettre à une personne ou à une entité visée à l’article 5 de cette loi de recueillir et d’utiliser les renseignements personnels d’un individu à son insu ou sans son consentement si les conditions ci-après sont réunies :<br/><br/>a) les renseignements personnels ont été communiqués à la personne ou à l’entité par un ministère, par une autorité publique ou par un organisme chargé de l’application de la loi,<br/><br/>b) les renseignements personnels sont recueillis et utilisés par la personne ou l’entité dans le but de détecter ou de décourager le recyclage des produits de la criminalité, le financement des activités terroristes ou le contournement de sanctions ou pour tout autre motif compatible.<br/><br/>Elle apporte également des modifications connexes à la Loi sur la protection des renseignements personnels et les documents électroniques.</div>","ShortLegislativeSummary":"<div>A legislative summary is currently being prepared for this bill by the Parliamentary Information, Education and Research Services of the Library of Parliament. Meanwhile, the following executive summary is available.<br/><br/>On 3 June 2025, the Minister of Public Safety introduced Bill C-2, An Act respecting certain measures relating to the security of the border between Canada and the United States and respecting other related security measures (Strong Borders Act) and it was given first reading.   <br/><br/>Part 1 amends the Customs Act to provide the Canada Border Services Agency with facilities free of charge for carrying out any purpose related to the administration or enforcement of that Act and other Acts of Parliament and to provide officers of that Agency with access at certain locations to goods destined for export. It also includes transitional provisions.<br/>Part 2 amends the Controlled Drugs and Substances Act to create a new temporary accelerated scheduling pathway that allows the Minister of Health to add precursor chemicals to Schedule V to that Act. It also makes related amendments to the Controlled Drugs and Substances Act (Police Enforcement) Regulations and the Precursor Control Regulations.<br/>Part 3 amends the Controlled Drugs and Substances Act and the Cannabis Act to confirm that the Governor in Council may, on the recommendation of the Minister of Public Safety and Emergency Preparedness, make regulations exempting members of law enforcement from the application of any provision of the Criminal Code that creates drug-related inchoate offences when they are undertaking lawful investigations.<br/>Part 4 amends the Canada Post Corporation Act to permit the demand, seizure, detention or retention of anything in the course of post only in accordance with an Act of Parliament. It also amends that Act to expand the Canada Post Corporation’s authority to open mail in certain circumstances to include the authority to open letters.<br/>Part 5 amends the Oceans Act to provide that coast guard services include activities related to security and to authorize the responsible minister to collect, analyze and disclose information and intelligence.<br/>Part 6 amends the Department of Citizenship and Immigration Act to authorize the Minister of Citizenship and Immigration to disclose, for certain purposes and subject to any regulations, personal information under the control of the Department within the Department and to certain other federal and provincial government entities.<br/>It also amends the Immigration and Refugee Protection Act to authorize the making of regulations relating to the disclosure of information collected for the purposes of that Act to federal departments and agencies.<br/>Part 7 amends the Immigration and Refugee Protection Act to, among other things,<br/>(a) eliminate the designated countries of origin regime;<br/>(b) authorize the Minister of Citizenship and Immigration to specify the information and documents that are required in support of a claim for refugee protection;<br/>(c) authorize the Refugee Protection Division of the Immigration and Refugee Board to determine that claims for refugee protection that have not yet been referred to the Refugee Protection Division have been abandoned in certain circumstances;<br/>(d) provide the Minister of Citizenship and Immigration with the power to determine that claims for refugee protection that have not yet been referred to the Refugee Protection Division have been withdrawn in certain circumstances;<br/>(e) require the Refugee Protection Division and the Refugee Appeal Division to suspend certain proceedings respecting a claim for refugee protection if the claimant is not present in Canada;<br/>(f) clarify that decisions of the Immigration and Refugee Board must be rendered, and reasons for those decisions must be given, in the manner specified by its Chairperson; and<br/>(g) authorize regulations to be made setting out the circumstances in which the Minister of Citizenship and Immigration or the Minister of Public Safety and Emergency Preparedness must designate, in relation to certain proceedings or applications, a representative for persons who are under 18 years of age or who are unable to appreciate the nature of the proceeding or application.<br/>It also includes transitional provisions.<br/>Part 8 amends the Immigration and Refugee Protection Act to, among other things,<br/>(a) authorize the Governor in Council to make an order specifying that certain applications made under that Act are not to be accepted for processing, or that the processing of those applications is to be suspended or terminated, when the Governor in Council is of the opinion that it is in the public interest to do so;<br/>(b) authorize the Governor in Council to make an order to cancel, suspend or vary certain documents issued under that Act, or to impose or vary conditions, when the Governor in Council is of the opinion that it is in the public interest to do so;<br/>(c) for the application of an order referred to in paragraph (b), require a person to appear for an examination, answer questions truthfully and produce all relevant documents or evidence that an officer requires; and<br/>(d) authorize the Governor in Council to make regulations prescribing circumstances in which a document issued under that Act can be cancelled, suspended or varied, and in which officers may terminate the processing of certain applications made under that Act.<br/>Part 9 amends the Immigration and Refugee Protection Act to add two new grounds of ineligibility for claims for refugee protection as well as powers to make regulations respecting exceptions to those new grounds. It also includes a transitional provision respecting the retroactive application of those new grounds.<br/>Part 10 amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to, among other things,<br/>(a) increase the maximum administrative monetary penalties that may be imposed for certain violations and the maximum punishments that may be imposed for certain criminal offences under that Act;<br/>(b) replace the existing optional compliance agreement regime with a new mandatory compliance agreement regime that, among other things,<br/>(i) requires every person or entity that receives an administrative monetary penalty for a prescribed violation to enter into a compliance agreement with the Financial Transactions and Reports Analysis Centre of Canada (the Centre),<br/>(ii) requires the Director of the Centre to make a compliance order if the person or entity refuses to enter into a compliance agreement or fails to comply with such an agreement, and<br/>(iii) designates the contravention of a compliance order as a new violation under that Act;<br/>(c) require persons or entities referred to in section 5 of that Act, other than those already required to register, to enroll with the Centre; and<br/>(d) authorize the Centre to disclose certain information to the Commissioner of Canada Elections, subject to certain conditions.<br/>It also makes consequential and related amendments to other Acts and the Proceeds of Crime (Money Laundering) and Terrorist Financing Administrative Monetary Penalties Regulations and includes transitional provisions.<br/>Part 11 amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to prohibit certain entities from accepting cash deposits from third parties and certain persons or entities from accepting cash payments, donations or deposits of $10,000 or more. It also makes a related amendment to the Proceeds of Crime (Money Laundering) and Terrorist Financing Administrative Monetary Penalties Regulations.<br/>Part 12 amends the Office of the Superintendent of Financial Institutions Act to make the Director of the Financial Transactions and Reports Analysis Centre of Canada a member of the committee established under subsection 18(1) of that Act. It also amends the Proceeds of Crime (Money Laundering) and Terrorist Financing Act to enable the Director to exchange information with the other members of that committee.<br/>Part 13 amends the Sex Offender Information Registration Act to, among other things,<br/>(a) make certain changes to a sex offender’s reporting obligations, including the circumstances in which they are required to report, the information that must be provided and the time within which it is to be provided;<br/>(b) provide that any of a sex offender’s physical characteristics that may assist in their identification may be recorded when they report to a registration centre;<br/>(c) clarify what may constitute a reasonable excuse for a sex offender’s non-compliance with the requirement to give at least 14 days’ notice prior to a departure from their residence for seven or more consecutive days;<br/>(d) authorize the Canada Border Services Agency to disclose certain information relating to a sex offender’s arrival in and departure from Canada to law enforcement agencies for the purposes of the administration and enforcement of that Act;<br/>(e) authorize, in certain circumstances, the disclosure of information collected under that Act if there are reasonable grounds to believe that it will assist in the prevention or investigation of a crime of a sexual nature; and<br/>(f) clarify that a person who discloses information under section 16 of that Act with the belief that they are acting in accordance with that section is not guilty of an offence under section 17 of that Act.<br/>It also makes a related amendment to the Customs Act.<br/>Part 14 amends various Acts to modernize certain provisions respecting the timely gathering and production of data and information during an investigation. It, among other things,<br/>(a) amends the Criminal Code to, among other things,<br/>(i) facilitate access to basic information that will assist in the investigation of federal offences through an information demand or a judicial production order to persons who provide services to the public,<br/>(ii) clarify the response time for production orders and the ability of peace officers and public officers to receive and act on certain information that is voluntarily provided to them and on certain information that is publicly available,<br/>(iii) specify certain circumstances in which peace officers and public officers may obtain evidence, including subscriber information, in exigent circumstances,<br/>(iv) allow a justice or judge to authorize, in a warrant, a peace officer or public officer to obtain tracking data or transmission data that relates to any thing that is similar to a thing in relation to which data is authorized to be obtained under the warrant and that is unknown at the time the warrant is issued,<br/>(v) provide and clarify authorities by which computer data may be examined, and<br/>(vi) allow a justice or judge to authorize a peace officer or public officer to make a request to a foreign entity that provides telecommunications services to the public to produce transmission data or subscriber information that is in its possession or control;<br/>(b) makes a consequential amendment to the Foreign Publishers Advertising Services Act;<br/>(c) amends the Mutual Legal Assistance in Criminal Matters Act to allow the Minister of Justice to authorize a competent authority to make arrangements for the enforcement of a decision made by an authority of a state or entity that is empowered to compel the production of transmission data or subscriber information that is in the possession or control of a person in Canada;<br/>(d) amends the Canadian Security Intelligence Service Act to, among other things,<br/>(i) facilitate access to basic information that will assist the Canadian Security Intelligence Service in the performance of its duties and functions under section 12 or 16 of that Act through information demands given to persons or entities that provide services to the public and judicial information orders against such persons and entities, and<br/>(ii) clarify the response time for production orders; and<br/>(e) amends the Controlled Drugs and Substances Act and the Cannabis Act to provide and clarify authorities by which computer data may be examined.<br/>Part 15 enacts the Supporting Authorized Access to Information Act.
